HomeMy WebLinkAbout92-30 - Assessment District 62RESOLUTION NO. 92- 30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ORDERING THE DISCONNECTION AND REMOVAL OF ALL OVERHEAD ELECTRIC OR COMMUNICATION FACILITIES PROVIDING SERVICE TO ANY BUILDING, STRUCTURE OR IMPROVEMENT LOCATED WITHIN THE BOUNDARIES OF ASSESSMENT DISTRICT NO. 62. WHEREAS, on January 14, 1991, after the close of a public • hearing, the City Council adopted a series of resolutions establishing Assessment District No. 62 under the provisions of the Municipal Improvement Act of 1913, being Division 12 of the Streets and Highways Code of the State of California, for the purpose of undergrounding utilities along Hazel Drive from Coast Highway southerly to Poppy Avenue; and WHEREAS, Section 5896.14 of the Streets and Highways Code provides that all electric or communication facilities located upon any lot or parcel of land within the assessment district shall be constructed, reconstructed, relocated or converted by the owner of such lot or parcel at his own expense; and WHEREAS, Section 5896.17 of the Streets and Highways Code provides that if the owner of any lot or parcel of land shall fail to comply with the requirements of said Section 5896.14, the City may order the disconnection and removal of all overhead electric or communication located upon such lot or parcel. Written notice of such proposed disconnection shall be given at least five days prior to disconnection by leaving a copy of such notice at the principal building, structure or improvement located upon such lot or parcel; and WHEREAS, the owners of several lots or parcels have failed to comply with the requirements of Section 5896.14 of the Streets and Highways Code. NOW, THEREFORE, BE IT RESOLVED as follows: That all electric or communication facilities located upon any lot or parcel of land within Assessment District No. 62 shall be constructed, reconstructed, relocated or converted by the owner of such lot or parcel at his own expense no later than five days after the Public Works Director has left a copy of a written notice at the principal building on said lot or parcel; and if the owner of any lot or parcel does not comply with said order, the public utility companies providing electric or communication service to said lots or properties are hereby order to disconnect and remove all overhead facilities providing service to said properties.
