HomeMy WebLinkAbout92-47 - Authorizing City Manager to Deny ClaimsRESOLUTION NO. 92- 47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE CITY MANAGER TO DENY CLAIMS. • WHEREAS, the City Manager as the Chief Administrative Officer of the City of Newport Beach and, as such, is largely responsible for the fiscal integrity of the City; and WHEREAS, the City Manager is familiar with all claims and lawsuits filed by persons seeking payment for personal injury or property damage allegedly caused by the City, its employees, or a condition of City property; and WHEREAS, state law authorizes the City Council to delegate, to the City Manager or other employee, the responsibility for denying claims and notifying the claimant of the action taken; and WHEREAS, state law also authorizes the City Council to delegate, to its attorney or the City Manager, the authority to settle or compromise claims for personal injury or property damage so long as the payment does not exceed $50,000; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: SECTION 1: The City Manager is hereby authorized to perform those functions otherwise to be performed by the City Council pursuant to the provisions of Section 905 et seq. of the Government Code; SECTION 2: The City Manager is hereby authorized to settle claims for personal injury or property damage so long as the payment by the City does not exceed $50,000.00.
