A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF NEWPORT BEACH SETTING FORTH
FINDINGS BASED ON LOCAL CONDITIONS WITHIN
THE CITY OF NEWPORT BEACH WHICH MAKE
CERTAIN MODIFICATIONS AND CHANGES TO THE
UNIFORM FIRE CODE.
• WHEREAS, it is the intent the City of Newport Beach
desires to adopt the 1991 Uniform Fire Code, published by the
International Conference of Building Officials and the Western
Fire Chiefs Association.
WHEREAS, the Fire Chief has recommended that changes and
modifications be made to the Uniform Fire Code, which are more
stringent than those published in the California Building
Standards Code and has advised that these changes and
modifications to the model code are reasonable necessary due
to local conditions in the City of Newport Beach and has
further advised that the remainder of the changes and
modifications are administrative or procedural in nature.
WHEREAS, Health & Safety Code Section 13143.5 requires
that before the City Council makes any changes or
modifications which are more stringent than the requirements
published in the California Building Standards Code relating
to fire and panic safety, that the Council make express
findings that such changes or modifications are reasonably
needed due to local climatic, geographic, or topographic
conditions,
NOW THEREFORE, BE IT RESOLVED by City Council of the City
of Newport Beach as follows:
SECTION I
The following changes and modifications to the 1991
Edition of the UNIFORM FIRE CODE as recommended by the Fire
• Chief are hereby found to be reasonably necessary due to local
climatic, geographical or topographical conditions:

1. Section 10.507(b) has been modified to require
installation of an automatic fire extinguishing
system in new all occupancies exceeding 5,000 square
feet. Existing occupancies, depending on the percent
of the added square footage vs. the original square
footage, may require the installation of an automatic
fire extinguishing system. This is required due to
the extended response times in Newport's sprawling
development separated by waterways and narrow and
congested streets. Newport Beach lies on or is
adjacent to the Newport /Inglewood earthquake fault.
Newport Beach covers methane gas fields within many
areas of the City. Automatic fire extinguishing
systems are reasonably necessary to provide immediate
life safety protection from fires that may result
from these unusual geological conditions.
SECTION II
A copy of this Resolution together with the Ordinances
adopting the City Codes shall be filed with the California
Department of Housing and Community Development by the City
Clerk of the City of Newport Beach as required by State law
(Section 17958.7 H & S Code).
