A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING APPLICATION BY THE
COUNTY OF ORANGE FOR A GRANT IN THE AMOUNT OF
$199,953.00 FROM THE DEPARTMENT OF FISH &
GAME - -OSPR FOR THE PREPARATION OF AN OIL SPILL
CONTINGENCY PLAN ELEMENT.
• WHEREAS, the People of the State of California have enacted
the Lempert -Keene Seastrand oil Spill Prevention And Response Act
Of 1990, which appropriates funds for grants to local governments
to prepare oil spill contingency plan elements of area plans; and
WHEREAS, the Department of Fish & Game Oil Spill Prevention
And Response Program ( "DFG- OSPR"), has been delegated the
responsibility for implementation of the grant program within the
State and establishing necessary procedures governing application
and selection of grant recipients under the program; and
WHEREAS, the County of Orange ( "County ") has been designated
lead agency and has the authority to complete, update, or review an
oil spill contingency plan element, on behalf of and with
participation from the cities of Huntington Beach, Newport Beach,
and San Clemente ( "participating cities "); and
WHEREAS, DFG -OSPR has selected the County, as lead agency, to
be the recipient of a grant; and
WHEREAS, procedures established by DFG -OSPR require that prior
to the County's submission of the grant agreement to the State, the
County must obtain resolutions from the legislative bodies of the
participating cities acknowledging the county as lead agency in the
preparation of the Oil Spill Contingency Plan element and
certifying the approval of the grant agreement; and
WHEREAS, the grant agreement contains terms and conditions
that County and the participating cities must comply with; and
WHEREAS, the City of Newport Beach is willing to participate
• in the grant program with the State of California to complete,
update, or revise an oil spill contingency plan element;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Newport Beach approves the grant agreement, acknowledges

the County as lead agency, and hereby authorizes the Chairman of
the Orange County Board of Supervisors or his designee to sign the
grant agreement and accept the grant for the purpose stated above.
