A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
DECLARING CITY'S INTENTION TO VACATION CERTAIN STREET RIGHTS -OF-
WAY IN TRACT NO. 7247 (SPYGLASS RIDGE); ADOPTING A MAP SHOWING
THE AREA TO BE VACATED AND SETTING A PUBLIC HEARING THEREON (DWG.
R /W- 5531 -L)
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act (Section 8300
• et sea. of the Streets & Highways Code) is authorized to vacate
public easements; and
WHEREAS, the City Council of the City of Newport Beach
on May 11, 1992, approved in concept, the conversion of public
streets, Ocean Birch Drive, Reef View Circle, Harbor Crest Circle,
Castle Cove Circle, Bay Cliff Circle, Sea Bell Circle and a portion
of Spy Glass Hill Road, to private streets and authorize the Public
Works Department to work with the community association toward
vacating the streets for the conversion; and
WHEREAS, a drawing of the right -of -way to be vacated is
depicted on a map which is attached hereto as Exhibit "A ", which
map is incorporated herein by reference and made a part of this
Resolution as though fully set forth at length; and
WHEREAS, proceedings for the vacation of the above -
described right -of -way shall be undertaken by the City Council of
the City of Newport Beach pursuant to the provisions of the Street
Vacation Act of 1941 and all amendments thereto, being Sections
8300 and 8325 and 8340 to 8353 inclusive, of the Streets and
Highway Code of the State of California;
NOW, THEREFORE, be it resolved by the City Council of the
City of Newport Beach that notice is given that the City Council of
the City of Newport Beach does hereby fix August 24, 1992, at the
hour of 7:00 p.m. of said day, in the City Council Chambers of the
City of Newport Beach, located at 3300 Newport Boulevard, Newport
Beach, California, as the time and place for hearing all persons
interested in or objecting to the proposed vacation of Ocean Birch
Drive, Reef View Circle, Harbor Crest Circle, Castle Cove Circle,
Bay Cliff Circle, Sea Bell Circle and a portion of spy Glass Hills
Road; the City Council at said time and place will hear the
evidence offered by any person interested in the vacation of the
right -of -way hereinbefore described.
BE IT FURTHER RESOLVED that this resolution of Intention
shall be published and posted as required by Sections 8322 and 8323
of the Streets and Highways Code. Copies of this resolution of
• intention shall be posted as provided in Section 8320 of the
Streets and Highways Code.
