HomeMy WebLinkAbout92-122 - Mariners Mile Specific Area PlanRESOLUTION NO. 92-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH INITIATING AMENDMENTS TO THE MARINERS MILE SPECIFIC AREA PLAN. WHEREAS, amendments to Title 20 of the Newport Beach Municipal • Code may be initiated by resolution of intention of the City Council; and WHEREAS, the City Council has reviewed and considered proposed amendments to the Mariners Mile Specific Area Plan relative to the dedication of property within the ultimate right -of -way for Pacific Coast Highway, as well as including some or all of the set back for properties on the north side of Pacific Coast Highway and the calculation of permitted gross floor area; and WHEREAS, the City Council desires to initiate the proposed amendments to Chapter 20.62 described in this Resolution as well as any related amendment to the Land Use Plan of the Local Coastal Program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: 1. It is the intention of the City Council to initiate amendments to Chapter 20.62 of the Newport Beach Municipal Code; 2. The proposed amendments to Chapter 20.62 to be considered by the Planning Commission shall read as follows: A. 20.62.030(b)(5). Except as otherwise provided in this subsection, the gross floor area and building bulk limits specified in Chapter 20.07 shall apply to all structures. For purposes of this Chapter, • the required setback specified in Section 20.62.050(c) shall be included in the calculation of buildable area for purposes of determining gross floor area and building bulk limits. Variances to exceed the base floor area ratio limits of Chapter 20.07 may be approved pursuant to Section 20.82.020(d). 1 B. 20.62.050(e) . Dedication. No dedication of right - of -way along the north side of Coast Highway shall be required pursuant to Chapter 13.05, or as a condition to any parcel map or use permit, for any project that strictly complies with the setback requirements in subsection (c). Nothing in this subsection shall affect the duty of a property owner to dedicate land and /or construct circulation system improvements pursuant to the provisions of the Traffic Phasing Ordinance (Chapter 15.40 of the • Newport Beach Municipal Code) , or to pay fees required by the Fair Share Traffic Contribution Ordinance (Chapter 15.38 of the Newport Beach Municipal Code). 3. Staff is also directed to initiate any required and related amendments to other plans such as the Land Use Plan of the Local Coastal Program; 4. The proposed amendments shall be considered by the Planning Commission which is requested to file a report of its findings and recommendations with the City Council as specified in Section 20.84.040 of the Newport Beach Municipal Code.
