A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CALLING AND GIVING NOTICE OF
A SPECIAL MUNICIPAL ELECTION TO BE HELD ON
TUESDAY, NOVEMBER 2, 1993, FOR THE SUBMISSION
OF AN ADVISORY MEASURE TO THE VOTERS OF THE
CITY OF NEWPORT BEACH.
• WHEREAS, pursuant to provisions of the City Charter of the
City of Newport Beach, Article XI, Section 5b of the California
Constitution and precedential decisions of the California Court of
Appeal, the City Council has the authority to submit advisory
measures on matters of municipal interest to the electors of the
City of Newport Beach; and
WHEREAS, the City Council desires to submit to the voters at
a Special Municipal Election to be held on November 2, 1993, a
measure seeking the advice of the electorate on the formation of a
city -wide assessment district to acquire, improve, and maintain
open space on the Castaways and Newporter North parcels
WHEREAS, the Newport Conservancy has agreed to reimburse the
City for all costs incurred in the conduct of the Special Election.
NOW, THEREFORE, BE IT RESOLVED, DECLARED, DETERMINED AND
ORDERED by the City Council of the City of Newport Beach as
follows:
Section 1. The City Council, pursuant to the provisions of
the City Charter, the Constitution of the State of California, and
relevant precedential decisions of the Court of Appeal, hereby
orders the following advisory measure submitted to the voters on
November 2, 1993 at the Special Municipal Election;
• Should the City Council of Newport Beach finance the
purchase, improvement, and maintenance of the
Castaways and Newporter North properties as
recreational and environmental open space through a
city -wide assessment district with annual assessments not
to exceed: 1. $120.00 per single family residential
unit;
2. $102.00 per unit for duplexes or

apartments;
3. $90.00 per unit for mobile homes;
4. $120.00 per each 2000 square feet of
commercial, industrial or institutional
building area.

Section 3. That the City Clerk is authorized, instructed
and directed to procure and furnish any and all official ballots,
notices, printed matter and all supplies, equipment and
paraphernalia that may be necessary in order to properly and
lawfully conduct the election.
Section 4. That the polls for the election shall be open
at 7:00 A.M.

Section 3. That the City Clerk is authorized, instructed
and directed to procure and furnish any and all official ballots,
notices, printed matter and all supplies, equipment and
paraphernalia that may be necessary in order to properly and
lawfully conduct the election.
Section 4. That the polls for the election shall be open
at 7:00 A.M.
of
the day of
the
election and
shall remain
open
continuously
from
that time
until
8:00 P.M. of
the same day
when
the polls shall be closed except as provided in Section 14301 of
the Elections Code of the State of California.
Section S. That in all particulars not recited in this
Resolution, the election shall be held and conducted as provided by
law for conduct of general municipal elections.
Section 6. That notice of the time and place for holding
the election is given and the City Clerk is authorized, instructed
and directed to give further or additional notice of the election
in the time, form and manner as required by law.
Section 7. The City Clerk shall certify to the passage and
adoption of this Resolution and enter it into the book of original
resolutions.
