HomeMy WebLinkAbout94-77 - Temporary Closure of Via Oporto and CentralRESOLUTION NO. 94-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE TEMPORARY CLOSURE OF VIA OPORTO AND CENTRAL WHEREAS, the California Vehicle Code authorizes the City to adopt rules • and regulations by ordinance or resolution regarding assemblages on and temporary closures of City streets; and WHEREAS, Chapter 10.08 of the Newport Beach Municipal Code provides that the City Council may adopt a resolution permitting the closure of a City street for the purpose of selling, storing, or displaying equipment, material, or merchandise for the conduct of special events involving a non - profit association provided a permit is issued by the City Manager pursuant to Chapter 5.10; and WHEREAS, Chapter 10.08 authorizes event sponsors to charge members of the general public for access to the event provided that the sponsor utilizes a procedure which allows members of the general public, without fee or charge, to access any property or structure within the area impacted by the closure; and WHEREAS, a special event permit has been issued to Jane Altman-Dwan to conduct an antique symposium and exhibition in the Lido Marina Village on September 17 and 18; which includes the temporary closure of Via Oporto and Central Avenue in the Lido Marina Village to display and sell merchandise. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: 1. Jane Altman-Dwan in association with South Coast Community Church shall be permitted to display merchandise and charge admission for access to an event which includes the closure of Central Avenue and Via Oporto in the Lido Marina Village between the hours of 6:00 AM Saturday, September 17 and 5:00 PM Sunday, September 18. 2. Jane Altman-Dwan in association with the South Coast Community Church shall be required to comply with the requirements of Municipal Code Chapter 10.08.030 (C).
