HomeMy WebLinkAbout95-138 - Disability Retirement Safety Member EmployeesRESOLUTION NO. 95 -138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH RESCINDING RESOLUTION #82 -69 AND HEREBY AUTHORIZING THE CITY MANAGER TO MAKE DETERMINATIONS REGARDING THE DISABILITY RETIREMENT OF • LOCAL SAFETY MEMBER EMPLOYEES OF THE CITY OF NEWPORT BEACH. 0 WHEREAS, the City of Newport Beach is a contracting agency of the Public Employees Retirement System; and WHEREAS, the Public Employees Retirement Law requires that a contracting agency determine whether a local safety member of such agency is disabled of purposes of the Public Employees Retirement Law and whether such disability is "industrial' within the meaning of such law; and WHEREAS, the City Council has determined upon legal advice it may delegate authority to make such determinations to the incumbent in the position of City Manager; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach does hereby delegate to the incumbent in the office of City Manager the authority to make determinations of disability under Section 21034 of the California Government Code, on behalf of the City and to determine if such disability is industrial and to certify such determinations and all other necessary information to the Public Employees Retirement System. BE IT FURTHER RESOLVED that such incumbent is authorized to make applications on behalf of the City for disability retirement of local safety member employees and to initiate requests for reinstatement of such employees who are retired for disability. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to transmit a certified copy of this Resolution to the Public Employees Retirement System, P.O. Box 1953, (1416 Ninth Street), Sacramento, California 95809. ATTEST City Clerk ADOPTED this 11th day of December -11995. Mayor
