RESOLUTION NO. 95 -139
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH RESCINDING
RESOLUTION #82 -113 AND HEREBY AUTHORIZING
THE CITY MANAGER TO MAKE APPLICATION
REGARDING THE DISABILITY RETIREMENT OF
LOCAL MISCELLANEOUS EMPLOYEES OF THE CITY
OF NEWPORT BEACH.
WHEREAS, the City of Newport Beach is a contracting agency of the Public
Employees Retirement System; and
WHEREAS, the Public Employees Retirement Law provides that a contracting
agency may apply to the Retirement Board to determine whether a member is disabled of
purposes of the Public Employees Retirement Law; and
WHEREAS, the City Council has detem-iined upon legal advice that pursuant to
Government Code Section 21023(c) it may delegate authority to make such determinations
to the incumbent in the position of City Manager;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Newport Beach does hereby designate to the incumbent in the office of City Manager the
authority to make applications for retirement for miscellaneous members where there is
evidence of disability.
BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to
transmit a certified copy of this Resolution to the Public Employees Retirement System,
P.O. Box 1953, (1416 Ninth Street), Sacramento, California 95809.
ADOPTED this 11th day of December -11995.
