HomeMy WebLinkAbout95-141 - Vacation of Sewer & Public Utility EasementRESOLUTION NO. 95 -141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING CITY'S VACATION OF A PORTION OF A SEWER AND PUBLIC UTILITY EASEMENT AT 3002 AND 3014 BREAKERS DRIVE, CORONA DEL MAR WHEREAS, the City Council of the City of Newport Beach, pursuant to the provisions to of the Street Vacation Act (Section 8300 et M. of the Streets & Highways Code) is authorized to vacate public easement; and WHEREAS, the City Council of the City of Newport Beach has reviewed and considered the various elements of the General Plan of the City of Newport Beach prior to declaring its intent to vacate this sewer easement and has determined that the proposed vacation is consistent with the General Plan. WHEREAS, the City Council of the City of Newport Beach held a public hearing on the proposed vacation of the sewer easement legally described on Exhibit "A" and depicted on a map attached as Exhibit "B" at 7:00 P.M. on December 11, 1995, in the Chambers of the City Council of the City of Newport Beach located at 3300 Newport Boulevard, Newport Beach, California; and WHEREAS, the City Council of the City of Newport Beach desires to vacate the sewer easement legally described in Exhibit "A" and depicted on the map depicted on Exhibit "B ", the vacation to be processed pursuant to the provisions of the Street Vacation Act. NOW, THEREFORE, be it resolved by the City Council of the City of Newport Beach that the sewer easement legally described in Exhibit "A ", and depicted on the map attached as Exhibit "B" is hereby ordered vacated and abandoned. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this resolution recorded by the Orange County Recorder. Adopted this 11th day of December 1995 EXHIBIT W That certain sewer easement, 4.00 feet wide, in the City of Newport Beach, County of Orange, State of California, described in deed to the City of Newport Beach filed in Book 2384, Page 341 of Official Records in the Office of the Recorder of said County more particularly described as follows: The southeasterly four (4) feet of Lots 26 and 28, Block A -36, Corona del Mar Tract, as said tract is laid out and shown upon a map recorded in Miscellaneous Maps, Book 3, Pages 41 and 42, records of Orange County, California.
