TITLE: Automatic Aid Agreement for Exchange of Fire, Rescue & Emergency Medical
Services Between the Orange County Fire Authority and the City of Newport Beach
ABSTRACT:
For more than fifty years, Orange County fire departments have been sharing resources across
jurisdictional boundaries to ensure prompt emergency service to our border constituents. This
has been accomplished through the use of automatic aid, mutual aid, and assistance for hire
agreements.
The City of Newport Beach (City) currently has an Automatic Aid Agreement between the
Orange County Fire Authority (OCFA) and the City dated January 1, 2002. OCFA has
requested use agreements for specialized equipment such as hazardous materials response
units and helicopters be modified. Consequently, staff is requesting approval of a revised
Automatic Aid Agreement with OCFA for Exchange of Fire, Rescue and Emergency Medical
Services.
RECOMMENDATION:
Approve the Automatic Aid Agreement with
Emergency Medical Services, and authorize
Agreement attached to the staff report.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
the OCFA for Exchange of Fire, Rescue &
the Mayor and City Clerk to execute the
Cross jurisdictional sharing of fire resources is accomplished through the use of automatic aid,
mutual aid, and /or assistance for hire agreements. Automatic aid agreements are those that
provide for the sharing of pre - selected resources from one jurisdiction into another, a�59
programmed into respective computer aided dispatch computers. Resource assignments occur
automatically, without any further review or request. Utilization of automatic aid between the
City and OCFA occurs seamlessly on a daily basis.
Mutual aid, by contrast, occurs when one agency makes the request of another agency, which
reviews each request before approving or disapproving the request. Mutual aid occurs on a
case -by -case basis and is not completely automated. An example of mutual aid requests
occurred when hundreds of mutual aid units responded into Laguna Beach during the 1993
firestorm. We have been a member of the Orange County Fire Services Operational Area
Mutual Aid Plan and the State of California Master Mutual Aid Agreement for many years.
Assistance by hire is when one agency agrees to pay another agency for the use of specified
resources. An example of this is when a jurisdiction uses aircraft for fighting fires; they pay for
the time used at the pre- agreed rate.
In general, this agreement acknowledges the shared benefit of cross- jursidictional assistance
as the policy of each party to the agreement and authorizes the Fire Chief from each jurisdiction
to establish the specific level of assistance with a Memorandum of Understanding (MOU). This
is consistent with the previous agreement between the City and OCFA. The purpose of the
MOU is to outline the procedures for implementing the Agreement between OCFA and the
City. The MOU is a guide for day -to -day operations. It is not intended to replace or revise the
Orange County Fire Services Operational Area Mutual Aid Plan. A copy of the MOU is attached
hereto as Attachment B.
OCFA and the City have found it to be of mutual benefit if the services of each fire department
are, in other jurisdictions not involving disasters, extended outside of the limits of each
jurisdiction into the boundaries of the other.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental
Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the
activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to
the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).

AUTOMATIC AID AGREEMENT FOR EXCHANGE OF FIRE, RESCUE &
EMERGENCY MEDICAL SERVICES
BETWEEN THE ORANGE COUNTY FIRE AUTHORITY
AND THE CITY OF NEWPORT BEACH
THIS AGREEMENT ( "Agreement') is made and entered into this _ day of
, 2013, by and between the ORANGE COUNTY FIRE AUTHORITY, a
California Joint Powers Authority ( "OCFA "), and the CITY OF NEWPORT BEACH, a
California municipal corporation and charter city in the County of Orange ( "CITY "), and is
made with reference to the following:

RECITALS
A. OCFA and CITY provide fire, rescue and emergency medical services within their
respective jurisdictions; and
B. On August 20, 1997, OCFA and CITY entered into an Operational Area Mutual Aid
Plan, the purpose of which is to support disaster operations in affected Orange
County jurisdictions by coordinating and providing mutual aid assistance as
requested and necessary; and
C. OCFA and CITY have found it to be of mutual benefit if the services of each fire
department are, in other situations not involving disasters, extended outside of the
limits of each jurisdiction into the boundaries of the other; and
D. On January 1, 2002, OCFA and CITY entered into an Automatic Aid Agreement for
Exchange of Fire, Rescue and Emergency Medical Services wherein, in some
circumstances, one party will automatically respond to a fire, rescue or emergency
medical incident occurring within the jurisdictional limits of the other party; and
E. The 2002 Automatic Aid Agreement was reviewed and the parties entered into a
Continuation Agreement on January 12, 2005; and
F. The parties hereto desire to amend the Automatic Aid Agreement for Exchange of
Fire, Rescue and Emergency Medical Services to update its provisions as set forth
herein.
NOW, THEREFORE, for and in consideration of the covenants contained herein,
the parties hereby agree as follows:
1. Purpose of Agreement.
A. OCFA and CITY acknowledge that the above Recitals are true and correct and are
hereby incorporated by reference into this Agreement.
B. The specific details of the service to be provided under this Agreement and the
general operational policies, including, but not limited to, types of equipment,

operational command, incident reports, dispatch and communications, training,
response maps and preplans, and response areas are set forth in the Operating
Plan (Exhibit A) and the Automatic Aid Response Areas (Exhibit B), which are
attached hereto and incorporated herein by reference.
C. This Agreement is a guide for day -to -day fire service operations. It is not intended
to replace or revise the Orange County Fire Services Operational Area Mutual Aid
Plan dated August 20, 1997 ( "OAMAP ") or the Mutual Threat Zone Operations
Guideline for the City of Newport Beach, the City of Laguna Beach and the Orange
County Fire Authority ( "MTZ ") dated February 2012, attached hereto as Exhibit C
and incorporated herein by reference.
D. The OCFA cost reimbursement rates, attached hereto as Exhibit D and
incorporated herein by reference, shall set forth the OCFA reimbursable rates for
equipment and personnel.
E. Evaluation of the effectiveness of this Agreement in accomplishing its purpose
shall be determined by the OCFA Fire Chief and the CITY Fire Chief.
2. Term and Termination.
This Agreement shall become operational and effective upon execution by both parties
and shall remain in effect until termination by either party. Either party may terminate the
Agreement at any time by giving written notice to the other party at least sixty days (60)
prior to the date of termination.
Responsibilities of Parties.
A. Each party shall, at its own expense, develop and provide for the necessary cross
connections of its communication system with the communication system of the
other.
B. Each party shall, at its own expense, provide to the other party a predetermined
grid mapping system designating the Automatic Aid Response Geographic Areas
subject to this Agreement, contained in Exhibit B.
C. Responsibility for responding to requests for ambulance service shall continue to
rest with the party in whose jurisdiction the emergency occurs.
4. Services to Be Performed.
A. Except as specifically provided in the Operation Plan attached hereto as Exhibit A,
OCFA and CITY shall perform and provide those services set forth in the Operating
Plan at no cost to the other party.

B. The OCFA Fire Chief and the CITY Fire Chief or their designated representatives
shall determine and agree upon the capabilities of each party to respond to
incidents requiring special equipment.
C. The responding party's response to a request for aid shall depend upon any
existing emergency conditions within its own jurisdiction and the availability of its
resources.
D. In the event an emergency is declared, this Agreement shall not constitute a waiver
of the rights of the respective parties to claim state and /or federal reimbursement.
5. Designated Representatives.
The OCFA Fire Chief and the CITY Fire Chief are designated as the representatives of the
respective parties to this Agreement, and they shall be jointly responsible for
administration of this Agreement.
Hold Harmless /Subrogation.
A. Notwithstanding the provisions of Government Code 895.2, each party shall
defend, indemnify, and hold harmless the other party and its officers, agents, employees
and representatives from any and all losses, liability, damages, claims, suits, actions and
administrative proceedings, and demands and all expenditures and cost relating to acts or
omissions of the Indemnitor, its officers, agents or employees arising out of or incidental to
the performance of any of the provisions of this Agreement. Neither party assumes
liability for the acts or omissions of persons other than each party's respective officers,
agents or employees.
B. Each party agrees that in the event of loss or injury to its employees, equipment or
property, which arises out of the performance of this Agreement, that each party will solely
look to its own funds and insurance for recovery. Each party grants to the other, on
behalf of any insurer providing insurance to either party, a waiver of any right to
subrogation which any such insurer of each party may acquire against the other party by
virtue of the payment of any loss under such insurance.
7. Other Provisions.
A. By entering this Agreement, neither party waives any of the immunities provided by
the Government Code or other applicable provisions of state or federal law.
B. This Agreement is not intended to confer any legal rights or benefits on any person
or entity other than the parties of this Agreement and shall not be enforceable by
any person or entity not a party to this Agreement.
C. Except as provided below, this Agreement may be amended only by a writter
document executed by the governing body of OCFA and the City Council of CITY

D. The Operating Plan contained in Exhibit A and the Automatic Aid Response
Geographic Areas contained in Exhibit B may be amended by a written document
executed by both the OCFA Fire Chief and the CITY Fire Chief. Any change in the
Operating Plan which constitutes a change in policy shall be approved by the
Governing Body of the OCFA and the City Council of the CITY.
E. The OCFA cost reimbursement rates attached hereto as Exhibit D may be
amended by a written document executed by both the OCFA Fire Chief and the
CITY Fire Chief.

OPERATING PLAN
Introduction
A. This Operating Plan is authorized in the Automatic Aid Agreement for Exchange of
Fire, Rescue and Emergency Medical Services dated
( "Agreement "), and is subject to the terms and conditions of that Agreement.
B. This Operating Plan is for the exchange of fire, rescue and emergency medical
services to the areas specified herein. The fire, rescue and emergency medical
services resources responding to emergencies will be as set forth below.
C. The purpose of this Operating Plan is to set forth the day -to -day operational
procedures for implementing the Agreement. It is not intended to replace, revise
or supersede the Orange County Fire Services Operational Area Mutual Aid Plan
dated August 20, 1997 ( "OAMAP "), or the Mutual Threat Zone Operations
Guideline for the City of Newport Beach, the City of Laguna Beach and the Orange
County Fire Authority ( "MTZ ") dated February 2012 and contained in Exhibit C. In
the event of any conflict between this Operating Plan and the OAMAP or MTZ, the
OAMAP and MTZ shall take precedence.
D. This Operating Plan replaces any existing Operating Plan or Memorandum of
Understanding (MOU) in effect between the OCFA and the CITY relating to
automatic aid for the exchange of fire, rescue and emergency medical services.
E. Changes in this Operating Plan may be made at any time by mutual written
agreement of the OCFA Fire Chief and the CITY Fire Chief. A signed amendment
to this document will be prepared accordingly and distributed to all holders. Any
change constituting a change in policy shall be subject to approval of the governing
board of the OCFA and the City Council of the CITY.
2. Definitions
For the purposes of this Operating Plan, the following definitions will apply to identified
fire, rescue and emergency medical services resources ('Resources "):
A. ALS: Advanced life support.
B. AUTOMATIC AID AREAS: Those geographic areas subject to this Agreement,
as set forth in Exhibit B.
C. BLS: Basic life support.
D. CHIEF OFFICER: An individual holding the rank of Fire Battalion Chief or higher,
capable of commanding incident resources and overall scene management.

E. DIRECT PROTECTION AREA (DPA): A party's own geographical jurisdiction.
F. ENGINE: A Resource as identified in FIRESCOPE ICS 420 -1 as a Type 1
Engine, staffed with a minimum of three (3) full -time professional firefighters
currently accredited by the Orange County Emergency Medical Services as
Emergency Medical Technician — Basic.
G. NFPA: National Fire Protection Association.
H. PARAMEDIC UNIT: A Resource providing a minimum staffing of one (1) full -time
professional firefighter accredited by the Orange County Emergency Medical
Services as a Paramedic.
SPECIALTY APPARATUS: A Resource provided pursuant to this Agreement for
which the recipient party will be charged. Specialty Apparatus includes, but is not
limited to, Water Tenders, Helicopters, Type III Engines, Heavy Rescue
Equipment, Heavy Fire Equipment, Type VI Patrols and similar apparatus.
J. SPECIALTY RESOURCE: a Specialty Apparatus and /or Specialty Service
Resource.
K. SPECIALTY SERVICE: A Resource provided pursuant to this Agreement for
which the recipient party will be charged. Specialty Service includes, but is not
limited to, Arson Investigators, Inspectors, hand crews, USAR, and similar
services.
L. TRUCK /QUINT: A Resource as identified in FIRESCOPE ICS 420 -1 as a Type 1
Truck, capable of providing a minimum 500 GPM elevated stream, 75 foot aerial
ladder, 115 feet of ground ladders, and staffed with a minimum of three (3) full -time
professional firefighters currently accredited by the Orange County Emergency
Medical Services as Emergency Medical Technician — Basic.
M. Additional Resources not described in this Operating Plan may be requested by
the Incident Commander or appropriate dispatch center through normal Mutual Aid
procedures prescribed in the OAMAP.
3. Emergency Incident Response
A. CITY and OCFA shall expeditiously provide Resources to an emergency incident
regardless of jurisdictional boundaries. Exhibit B lists the geographic areas
subject to this Agreement. CITY and OCFA shall dispatch the closest,
appropriate Resource to the geographical areas noted in Exhibit B upon
notification of an emergency incident.

B. Automatic aid provided pursuant to this Agreement shall consist of providing "First
Alarm" type fire and emergency medical services as described in the requesting
party's response matrix set forth in Section 5, below.
C. Additional Resources and /or special equipment needed to meet unusual
emergency needs may be requested by the Incident Commander or appropriate
dispatch center through normal mutual aid procedures prescribed in the OAMAP.
D. The requesting party shall provide patient transportation in accordance with the
requesting party's contract or policy.
4. Dispatch Procedures
Request for services will follow the guidelines set forth below:
A. Contact shall be made to the Dispatch Center through CAD -to -CAD or
pre - established communication links requesting the closest Resource.
B. Whenever possible, utilization of an Automatic Vehicle Locator (AVL) system will
be used to determine the closest appropriate Resource to the incident.
C. All necessary information including address, type of emergency, Dispatch Center,
assigned radio channel(s) and available related information shall be relayed via
radio and confirmed by responding party and updated as appropriate.
D. If the requested Resource is unable to respond within the NFPA turnout time of one
minute, the requesting party's Dispatch Center will be advised of the delay.
E. If the requested Resource encounters delays resulting from traffic, weather or
other restrictions so as to result in an extended response time, the requesting
party's dispatch center will be immediately advised of the delay.
F. Dispatch into the geographic areas set forth in Exhibit B shall be automatic.
G. Automatic Aid shall be provided at no cost for those Resources set forth herein,
other than Specialty Apparatus and Specialty Services. The party responsible for
the DPA over the Automatic Aid Area receiving Specialty Resources shall
compensate the party providing the Resources for all Specialty Apparatus and
Specialty Services. Such compensation shall be at a rate approved by both
parties pursuant to an Assistance -by -Hire (ABH) rate Agreement.
H. Automatic Aid shall apply only to emergency incidents and shall not apply to
non - emergency situations such as water evacuations, public assistance, odor
check, and similar situations. Hazardous Materials Incidents are not subject to
this Agreement.

I. Station coverage is NOT included in this Agreement but may be requested
separately, subject to availability and approval by both parties.
5. Response Matrix
A. Upon notification by OCFA, CITY shall automatically dispatch into Automatic Aid
Areas the following Resources in accordance with Resource response guidelines,
where CITY Resources are closer than OCFA Resources:

6. Operational Command
The first arriving company officer (Engine, Truck, Paramedic Unit, etc.) shall assume
command until he /she reassigns command or is relieved by a Chief Officer. The
highest- ranking Chief Officer from the party having jurisdiction shall assume command.
All operations shall be conducted in a coordinated and organized manner consistent with
ICS420 -1, Incident Command System.
7. Incident Reports
When Resources from both parties have responded to an incident, the party having
jurisdiction will be responsible for preparing the incident report. When no Resources
from the party having jurisdiction respond to an incident, the Resources from the
responding party shall prepare their own incident report and provide copies of the incident
report to the party having jurisdiction.
8. Training
Periodic interagency training shall be conducted to enhance operational coordination
between CITY and OCFA Resources. This training shall be scheduled through CITY
Fire Chief and the OCFA Fire Chief or their designees.
9. Response Maps and Pre -Plans
Upon execution of this Operating Plan, each party shall provide the other with current
standard response maps and shall provide updated versions as changes occur.
10. Evaluation
The effectiveness of this Operating Plan shall be evaluated annually, or as significant
changes occur, by the CITY Fire Chief and OCFA Fire Chief or their designees.

Mutual Threat Zone Operations Guideline for the Cities of Newport Beach
(NPB), Laguna Beach (LAB) and the Orange County Fire Authority (ORC)
Effective February 3, 2012.

of resources by creating an agreed77 upon MTZ response mop with pre - identified fire districts, a
MM Fire Station Order (FSO), ads a pre•idaotfied Central Ordering Perm (COP). This
guidelino will Woo strew the impoi tanee of Unificd Command and lateropereble communications
by having o Chief Officer (CO) gvm each agency dispatched in the pro- idmiled NM response
district, using the pre- identified eammuniesdoas plan.

The following odes of engagement have been apxd to by the Cities ofNewpuri Beach, Logtow
Beaclh and the Orange County Fite Authority for vegetation fires in the MT7-
1. The anached MTZ response map, with praideatfied districts, will become the basis
fardispulahing a Mn response.
2. The agreed -upon MTZ FSO will be based on "closest twlt(s)" or Nwieny unlosy'.
3. The MTZ response will be implemented for teponed vegetaGm fires in the wateahed
within the MTZ districts. Once the cal I -raker caters the information into the CAD
and it is detemhinei to be a MTZ response, a y'wgle response based on the agreed -
upon MTZ FSO will be dispatched, including a CO from each agency by OCFA CCC

between the
ORANGE COUNTY FIRE AU'f E[ORITY and the CITY 017 NEWPORT BEACH
This Nlcmorarrdum of Understanding ( "MOU ") is authorized by the City of Newport Beach Fire
Chief and the Orange County Fire Authority Fire Chief in an Agreement for Exchange of Fire,
Rescue and Emergency Medical Services dated January I, 2002 and is subject to the terms and
conditions set forth in said Agreement.
The purpose of this MOU is to outline the procedures for implementing the Agreement between
the City of Newport Beach Fire Department, hereinafter referred to as "CITY" and the Orange
County Fire Authority, hereinafter referred to as " AUTI-IORffY ". This MOU is a guide for day -
to -day operations. It is not intended to replace or revise the Ot-ange County Fire Services
Operational At-ea rllulual Aicl Plcrn. This NIOU replaces any existing NIOU in effect between
AUTHOlUTY and CITY.
AI40UNT AND TYPE OF ASSISTANCE
This MOU is for the exchange of Eire, rescue and emergency medical services to the areas
specified. The identified lire department resources will respond to emergencies as set l.orth
below. For the purposes of this NIOU, [lie following definitions will apply to identified
resources:
BATTAI ION CI -LIEF: Refers to an officer capable of and responsible for commanding
incident resources and overall scene management.
ENGINE: Refers to a fire department resource meeting the equipment
standards of a FIP.ESCOPE ICS Type I Engine with a mininlu n
staffing of three (3) personnel.
1-IEUCOPTER: Refers to a FIRESCOPE ICS Type 2 helicopter with water
dropping capability owned and operated by the Orange County Fire
Authority.
PARAMEDIC: Refers to a fire department resource providing advanccd life
support services in compliance with Orange County EMS Agency
Policy and Procedure #090.00 definitions for "advanced life
support'; "advanced life support unil "; and "emergency medical
technician/ paramedic ".
TRUCK: Refers to a fire Clef), •unent resource capable of providing a
minimum elevated stream and rescue capability of not less than
fifty (50), feet and a minimum staffing of three (3) personnel.

Additional resources not described in this NIOU may be requested by the Incident Commander or
appropriate dispatch center through 1101-11181 IVIutuat Aid channels as outlined in the Orange
C'aunly Fire Services Operalional Area kfulual Aid Peen.
RESPONSE ARIAS
I. CITY SHALL PROVIDE:
III accordance with dispatch procedures, up to five ENGINES, one BATTALION CHIEF,
one TRUCK and two PARAMEDICS from CITY stations to districts within the
AUTHORITY'S jurisdiction where CITY resources are closer.
The CITY shall also provide a second TRUCK to areas of AUTHORITy jurisdiction
along Coast Highway south to and including Emerald Bay where the CITY resource is
closer.
See Attachlucnt A for response areas.
2. AU ROIUTY SHALL PROVOL:
L1 accurclance with dispatch procedures, up to five FINGNES, one BATTALION CHIL'•F,
one TRUCK and one PARAMEDIC from AUTHORITY Stations to districts within the
CITY's jurisdiction where AU'ft- tORffY resources are closer.
The Aurt-to L"rY shall also provide one HELICOPTER into areas of Newport Beach,
illustrated in Attachment 13, on each instance of a vegetation fire for a single period of
two hours. After the first bvo -hour period of non- reinhbursed aid, use of the
HELICOPTER will be reimbursable as Assistance by Hire at the OCf A Board approved
Forest Agency rate, plus any additional cxpenclecl costs for I- IELICOPTER support.
See Attachment 13 for response areas.
3. BOTH AGENCIES SHALL PROVIDE:

BATTALION CHIEF, one TRUCK and one PARAMEDIC to all freeways and tolhvays
as needed based on closest Units.
Changes in this written N,IOU may be made at any time by mutual written agreement of the
AUTHORITY Fire Chid anti CffY Fire Chief. A signed amendment to this document will be
prepared accordingly and distributed to all holders.
OPISRAT10NA1, C0NIA4AND
The first arriving officer will assume command Until he or she reassigns command or is relievecl
by a chief officer. The highest - ranking officer from the authority havin0 jurisdiction will have
the u161118te authority to assume command. All operations will be conducted in a coordinated and

organized manner.
INCI DENT REPORTS
When units of both agencies have responded to an incident, the unit of the agency having
jurisdiction will be responsible for preparing the incident report. When no units fi•om the
jurisdictional agency respond to an incident, the units from the responding jurisdiction shall
prepare their own incident report and the responding agency shall provide copies of the incident
report to tilejurisdicLional agency.
DISPATal AND COMiNtUINICATIONS
Request for services will follow the guidelines noted below:
a) Contact shall be made to the dispatch center through pre - established conununication links
requesting a resource by fire station and unit type identified in this Agreement.
b) All necessary information including address, type of emergency, tactical radio channel
and related information that is available shall be relayed to responding units and updated
as appropriate.
c) The agency receiving the request shall dispatch the requested resource, if available, and
shall provide the responding units with all pertinent information, identifying the
jurisdictional dispatch center and tactical radio channel.
(1) If the requested type of unit is not in the station requested and located so as to result in an
extended response time, the requesting agency's dispatch center will be advised of the
delay to ensure that the closest unit will respotnd.
e) Lf the requested unit encounters delays resulting from seasonal, traffic, or other
restrictions, so as to result in an extended response lime, the requesting agency's dispatch
center will be immediately advised of the delay.
TRAINING
Periodic interagency training shall be conducted Ivor the purpose of innproving working
relalimiships and operational coordination between CITY and AU'I1101UTY units. This (raining
shall be coordinated through the arcs fire Operations Officer and the AUTt- miurY's
Battalion Chief assigned as I:he liaison N the CITY fire department.
RESPONSE MAPS AND PREPLANS
Upon execution of this NIOU, each agency shall provide the other with current standard response
maps and shall provide updated versions as changes occur.

EVALUATION
The effectiveness of the procedures contained in this NIOU shall be evaluated annually, or as
significant changes occur, by the C[TY's Piro Operations Officer and the AU'fF[ORl "I'Y,s
Battalion Chief assigned as the liaison to the CITY fire department.
