HomeMy WebLinkAbout2014-39 - Amending Resolution No. 2013-33 to Modify the Parking Rates for the Corona del Mar State Beach Parking LotRESOLUTION NO. 2014-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING RESOLUTION NO. 2013 -33 TO MODIFY THE PARKING RATES FOR THE CORONA DEL MAR STATE BEACH PARKING LOT WHEREAS, the City of Newport Beach ( "City ") currently operates the manned parking lot at Corona del Mar State Beach; WHEREAS, on February 26, 2013, the City Council approved Budget Amendment 13 -034 for the acquisition and installation of 23 automated pay stations — 11 at the Balboa Pier Parking Lot and 12 at the Corona del Mar State Beach Parking Lot; WHEREAS, California Vehicle Code Section 22508, Vehicle Code Section 32 and Newport Beach Municipal Code Section 12.44.030 authorize the City to establish off - street parking meter zones by resolution and establish rates for parking meter zones; WHEREAS, the City Council adopted Resolution No. 2013 -33 on April 9, 2013, which established off - street parking meter zones for the Balboa Pier Parking Lot and Corona del Mar State Beach Parking Lot and adopted the rate schedule as set forth in Resolution 2010 -40; WHEREAS, on April 11, 2014, the California Coastal Commission approved Coastal Development Permit No. 5 -13 -0507, for the installation of pay stations at the Corona del Mar State Beach Parking Lot, subject to standard and special conditions which necessitate the amendment of the Corona del Mar State Beach Parking Lot parking rates. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: Section 4 of Resolution No. 2013 -33 is hereby modified as follows: Except for a reduction or elimination of the fee, no changes shall be made in the below parking fees within three (3) years of the operation of the pay stations at the Corona del Mar State Beach Parking Lot. All parking rates are for per vehicle space occupied. Non- Holidav Rates: Peak (May — September) 6:00 a.m. — 9:00 a.m.: $2.50 /hr 9:00 a.m. — 6:00 p.m.: $4.00 /hr 6:00 p.m. — 10:00 p.m.: $2.50 /hr Off -Peak (October — April) Weekdays: 6:00 a.m. — 10 p.m.: $1.50 /hr Weekends (Saturday and Sunday): 6:00 a.m. — 9:00 a.m.: $2.50 /hr 9:00 a.m. — 6:00 p.m.: $4.00 /hr 6:00 p.m. — 10:00 p.m.: $2.50 /hr $15 /day maximum Holiday Rates (Memorial Day, Independence Day and Labor Day) 6:00 a.m. — 10:00 p.m.: $4.00 /hr $20 /day maximum Such rates shall apply only on the actual holiday dates, and do not apply to the holiday week or the holiday weekend. Section 2: The Parking Management Program for Zone 30 shall consist of the rates presented in Section 1 and the hours of operation in Section 5 of Resolution 2013- 33. Section 3: The City Council finds that the modification of parking meter fees is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 4: This resolution shall take effect for Zone 30 following its adoption by the City Council and the operation of the first parking payment center in Zone 30.
