RECOMMENDATION: Adopt Resolution No. 2014 -39, A Resolution of the City Council of the City of Newport Beach Amending Resolution 2013 -33 to Modify the Parking Rates for the Corona del Mar State Beach Parking Lot, as follows: All parking rates are for per vehicle space occupied. Non - Holiday Rates: Peak (May — September) 6:00 a.m. — 9:00 a.m.: $2.50 /hr 9:00 a.m. — 6:00 p.m.: $4.00 /hr 6:00 p.m. — 10:00 p.m.: $2.50 /hr Off -Peak (October — April Weekdays 6:00 a.m. — 10 p.m.: $1.50 /hr Weekends (Saturday and Sunday): 6:00 a.m. — 9:00 a.m.: $2.50 /hr 9:00 a.m. — 6:00 p.m.: $4.00 /hr 6:00 p.m. — 10:00 p.m.: $2.50 /hr $15 /day maximum 233 Holiday Rates (Memorial Day, Independence Day and Labor Day) 6:00 a.m. — 10:00 p.m.: $4.00 /hr $20 /day maximum Such rates shall apply only on the actual holiday dates, and do not apply to the holiday week or the holiday weekend. Except for a reduction or elimination of the fee, no changes shall be made in the parking fees within three (3) years of the date of operation of the pay stations at the Corona del Mar State Beach Parking Lot. FUNDING REQUIREMENTS: While we do not have previous experience with an hourly rate structure at Corona del Mar State Beach, we estimate the proposed rate structure will be relatively cost neutral and will encourage greater use of the lot during low demand periods. DISCUSSION: On February 26, 2013, the City Council approved Budget Amendment 13 -034 for the acquisition and installation of 12 automated pay stations ('Pay Stations ") for use at the Corona del Mar State Beach Parking Lot. While no rate changes were initially proposed to the flat day - use rate of $15.00 per day, the Coastal Commission asked that the City provide hourly parking options to encourage greater access to the beach, with incentive rates during low -use times of the day and week. After many deliberations with Commission staff, we believe we reached agreeable terms. On April 11, 2014, the California Coastal Commission approved Coastal Development Permit ( "CDP ") No. 5 -13 -0507 for the installation of 12 Pay Stations at the Corona del Mar State Beach Parking Lot, with the following Special Conditions related to parking fees: 1. Provide hourly parking rates, taking into consideration peak and non -peak seasons and peak and non -peak hours. Hourly parking rates per vehicle space occupied during the peak season (May- September) shall not exceed: $2.50 /hour rate all week during the morning hours between 6 a.m. and 9 a.m. $4.00 /hour rate all week between 9 a.m. and 6 p.m. $2.50 /hour all week during the evening hours between 6 p.m. and 10 p.m. Hourly parking rates per vehicle space occupied during the off -peak season (October - April) shall not exceed: Weekday rate of $1.50 /hour all day from 6 a.m. — 10 p.m. Weekend rate of $2.50 /hour from 6 a.m. — 9 a.m. Weekend rate of $4.00 /hour from 9 a.m. — 6 p.m. Weekend rate of $2.50 /hour from 6 p.m. — 10 p.m. The user may pay by the hour, but shall not pay in excess of the maximum fee of $15 per day per space occupied year- round, except for the holidays below. 2. Hourly parking rates per vehicle space occupied on Memorial Day, Independence Day (4th 234 of July), and Labor Day, shall not exceed $4.00 /hour (6 a.m. — 10 p.m.), with a daily maximum parking fee of $20.00. The parking fee schedule shall indicate that these holiday parking fees apply only on the actual holiday and not the entire holiday week or holiday weekend. The user may be given the option to pay by the hour or pay the maximum fee, but shall not pay in excess of the maximum holiday fee. 3. Except for a reduction or elimination of the fee, no changes in the parking fee schedule shall occur within the initial three year monitoring period. In order to comply with these conditions, staff proposes revising the current parking rates from: Non - Holiday Rates: Automobiles — $15.00 /daily flat rate Motorcycles — $7.50 /daily flat rate Recreational Vehicles — $15.00 /daily flat rate, per parking space occupied Buses — 10 -24 passengers - $50 /flat rate; 25+ passengers - $100 /flat rate Holiday Rates: Automobiles — $25.00 /daily flat rate Motorcycles — $12.50 /daily flat rate Recreational Vehicles — $15.00 /daily flat rate, per parking space occupied Buses — 10 -24 passengers - $50 /flat rate; 25+ passengers - $100 /flat rate to: Non - Holiday Rates: Peak Season (May — September) 6 a.m. — 9 a.m.: $2.50 /hr 9 a.m. — 6 p.m.: $4.00 /hr 6 p.m. — 10 p.m.: $2.50 /hr Off -Peak Season (October — April) Weekdays: 6 a.m. — 10 p.m.: $1.50 /hr Weekends (Saturday and Sunday): 6 a.m. — 9 a.m.: $2.50 /hr 9 a.m. — 6 p.m.: $4.00 /hr 6 p.m. — 10 p.m.: $2.50 /hr $15 /day maximum Holiday Rates (Memorial Day, Independence Day and Labor Day) 6 a.m. — 10 p.m.: $4.00 /hr $20 /day maximum As part of its approval, the California Coastal Commission requires the City to collect and 235 analyze the parking data at the Corona del Mar State Beach Parking Lot in order to determine the effect of the Pay Stations on parking, parking visitation, revenues and public access. The data and analysis shall be submitted annually to the Executive Director, commencing one year from the date the Pay Stations begin operation, for a three year period. Staff is optimistic that this rate schedule will encourage more visitors to use the lot when visitors intend to visit the concession or make a brief visit to the beach and water for a volleyball game or an ocean swim. We hope, too, that fewer people will park in the streets of Corona del Mar where once their sole purpose of doing so was to avoid the no- option $15 fee. City parking passes will still allow users at CdM State Beach to park without additional payment beyond the purchase price of their pass. As the City's contractor intends to use license -plate recognition devices to monitor payment compliance, parking passholders will have their pass assigned to a specific license plate. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING RESOLUTION NO. 2013 -33 TO MODIFY THE PARKING RATES FOR THE CORONA DEL MAR STATE BEACH PARKING LOT WHEREAS, the City of Newport Beach ( "City') currently operates the manned parking lot at Corona del Mar State Beach; WHEREAS, on February 26, 2013, the City Council approved Budget Amendment 13 -034 for the acquisition and installation of 23 automated pay stations — 11 at the Balboa Pier Parking Lot and 12 at the Corona del Mar State Beach Parking Lot; WHEREAS, California Vehicle Code Section 22508, Vehicle Code Section 32 and Newport Beach Municipal Code Section 12.44.030 authorize the City to establish off - street parking meter zones by resolution and establish rates for parking meter zones; WHEREAS, the City Council adopted Resolution 2013 -33 on April 9, 2013, which established off - street parking meter zones for the Balboa Pier Parking Lot and Corona del Mar State Beach Parking Lot and adopted the rate schedule as set forth in Resolution 2010 -40; WHEREAS, on April 11, 2014, the California Coastal Commission approved Coastal Development Permit No. 5 -13 -0507, for the installation of pay stations at the Corona del Mar State Beach Parking Lot, subject to standard and special conditions which necessitate the amendment of the Corona del Mar State Beach Parking Lot parking rates. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: Section 4 of Resolution No. 2013 -33 is hereby modified as follows: Except for a reduction or elimination of the fee, no changes shall be made in the below parking fees within three (3) years of the installation of the pay stations at the Corona del Mar State Beach Parking Lot. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: Section 3 of Resolution No. 2013 -33 is hereby modified as follows: Rates for Zone 29 on Memorial Day. Zone 30: The parking lot located at the Corona del Mar State Beach, which is under the City's control through an Operating Agreement between the City and the State of California dated August 1, 1999, as may be hereafter amended or renewed. The plan shall demmonstrate the proposed location for the signage and shall not result in the direct, placement of signage poles in sandy beach areas or other sensitive resource areas. 2. The plan shall include, at a minimum, the following components: sign material, dimensions, appearance, and clearly legible wording, etc. 3. Signs submitted ptrsuant to this plan shall comply with the requirements of Special Condition Noi 3 (State Tidelands Access) of this coastal development permit. 4. The plan shall demonstrate that poles, signs and machines are placed and oriented to minimize impacts on public views of the water. The permittee shall undertake development in accordance with the approved final plan. Any proposed changes to tl{e approved final plan shall be reported to the Executive Director.
