CURRENT BUSINESS ITEM NO. 1 LAND USE ELEMENT AMENDMENT (PA2013 -098) Site Location: City -wide Summary: The Land Use Element Amendment Committee completed their review of the proposed Land Use Element land use designation and development capacity changes and policy, glossary and Implementation Plan changes at their final meeting on April 1, 2014. This is the first of two scheduled Planning Commission study sessions on this item. Topics for this study session include, but are not limited to: • Draft Changes for Land Use Designations and Development Capacities • Draft Revisions of Land Use Goals and Policies • Draft Additions to the General Plan Implementation Programs • Draft Additions to the General Plan Glossary Recommended Action: Continue discussion to May 22, 2014, Study Session C. PUBLIC COMMENTS Public comments are invited on items generally considered to be within the subject matter jurisdiction of the Planning Commission. Speakers must limit comments to three (3) minutes. ITEM NO. 2 NESAI RESTAURANT (PA2013 -203) Site Location: 217 Riverside Avenue Summary: A conditional use permit to remodel an existing restaurant currently operating with a Type 47 (On- Sale General) Alcoholic Beverage Control license, adding an outdoor dining patio, and extending service to include late hours of operation (after 11:00 p.m.). Also included is a request to waive a portion of the required parking and approve a parking management program that includes off -site parking at 2660 Avon Street, annual employee parking passes for use in the City municipal parking lot (Mariners Mile Lot), and valet parking. Due to the late hours of operation, approval of an Operator's License by the Newport Beach Police Department will be required. CEQA Compliance: The project is categorically exempt under Section 15301, of the California Environmental Quality Act (CEQA) Guidelines - Class 1 (Existing Facilities). The proposed project involves the minor alteration of an existing structure. Recommended Action: 1. Conduct public hearing; and 2. Adopt Resolution No. _ approving Conditional Use Permit No. UP2013 -021 subject to the conditions of approval provided in the draft resolution and superseding Use Permit No. UP1677. 1 of 2 340 VAR X. ITEM NO. 3 MEDICAL OFFICE PARKING MODIFICATION APPEAL (PA2013 -228) Site Location: 441 Old Newport Boulevard Summary: A Modification Permit request to make use of a combination of vehicle lifts, tandem parking spaces, surface parking spaces and valet parking to accommodate the 56 minimum required parking spaces for proposed medical offices in an existing office building. CEQA Compliance: The project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). Recommended Action: Conduct a de novo public hearing and uphold or reverse the Zoning Administrator's decision by: Finding that the project is exempt under Section 15303 of the State CEQA (California Environmental Quality Act) Guidelines — Class 3 (New Construction or Conversion of Small Structures) and adopt the draft resolution for approval to uphold the Zoning Administrator's decision and approve Modification Permit No. MD2013 -023; or 2. Adopting the draft resolution for denial to reverse the Zoning Administrator's decision. Find that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15270 of the CEQA Guidelines.
