Brown, City Clerk PHONE: (949) 644 -3005 TITLE: Appointments to the Corona del Mar Business Improvement District Advisory Board of Directors for FY 2014 -15 ABSTRACT: The California Streets and Highways Code Sections 36500 et seq., grants the City Council the authority to appoint an advisory board for Business Improvement Districts formed under the Parking and Business Improvement Area Law of 1989. RECOMMENDATION: Appoint Tom Nicholson, representing Graviti Fitness, and Scott Palmer, BID Systems Inc., to the Corona del Mar Business Improvement District (BID) Advisory Board of Directors for FY 2014 -2015. FUNDING REQUIREMENTS: The City of Newport Beach, or its approved designee, collects the member assessments on behalf of the Corona del Mar BID and remits the monies back to the BID for funding the activities listed in its annual report to the City Council. In addition to the assessments, the City's FY 2014 -2015 budget includes sufficient funding for providing $20,000 in funding to the BID to help support its operation and marketing efforts. DISCUSSION: On May 27, 2014, the City Council confirmed the appointments of Bernie Svalstad of BPS Newport Financial, Keith Dawson of Dawson & Dawson, Jessica Prause of the New Port Theatre, Jim Walker of The Bungalow Restaurant, Karen Yould of Corona del Mar Florist, Scott Laidlaw of Laidlaw Schultz Architects, and Shawn Lim of Rose Bakery to the Corona del Mar BID Advisory Board of Directors for FY 2014 -2015. On May 8, 2014, at the request of the Corona del Mar BID, the City Council adopted Resolution No. 2014- 57 that increased the BID's Advisory Board membership from seven members to nine members. The City Clerk posted the Notice of Vacancies in the City Clerk's Office and on the bulletin board on July 9, 2014; and published the Notice of Vacancies in the Daily Pilot on July 12, 2014. The City Clerk prepared and posted a Notice of Vacancies on Monday, July 7, 2014 in the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers. The Notice of Vacancies was also posted on the City's webpage on Monday, July 7, 2014, and was published in the Daily Pilot on Saturday, July 12, 2014. Pursuant to the Notice of Vacancies, applications were accepted by the City Clerk's Office until 4:00 p.m. on Tuesday, July 22, 2014. At the conclusion of the application period, the City Clerk's Office received applications from Tom Nicholson, representing Graviti Fitness, and Scott Palmer, BID Systems Inc. At the July 24, 2014 Corona del Mar BID Advisory Board meeting, the Advisory Board recommended appointing Scott Palmer and Tom Nicholson to fill the two, newly created Advisory Board seats for FY 2014 -2015. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
