Alford, Planning Manager PHONE: (949) 644 -3235 TITLE: Budget Amendment to Cover Additional Costs for the John Wayne Airport (JWA) Settlement Agreement's Environmental Impact Report (EIR) ABSTRACT: A budget amendment to transfer $185,000 from the General Fund to City Council's Airport Management Division Budget, Professional & Technical Account for costs associated with the preparation of an environmental impact report (EIR) for the extension of the John Wayne Airport Settlement Agreement. RECOMMENDATION: a) Find that the Budget Amendment is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(2) of the CEQA Guidelines; and b) Approve Budget Amendment No. 15BA -004 to increase expenditure appropriations in the City Council's Airport Management Division Budget, Professional & Technical Account, 0121 -8080, by $185,000, from the General Fund unappropriated fund balance. DISCUSSION: Background On April 16, 2013, the City, County of Orange, Stop Polluting Our Newport (SPON), and Airport Working Group (AWG) entered into a Memorandum of Understanding (MOU) to define their respective roles and responsibilities in the preparation of an EIR for the extension of the 1985 John Wayne Airport Settlement Agreement. Under the terms of the MOU, the costs of preparing the EIR will be shared equally by the City and County. On September 13, 2013, the City Council allocated $525,696 to cover the City's share of the John Wayne Airport Settlement Agreement EIR. Analysis On July 22, 2014, the Orange County Board of Supervisors approved amendments to the contracts of four environmental consultants for additional work on the EIR and associated technical analyses for the proposed Settlement Agreement Amendment (see Attachment CC 1). The approved budget amendment totaled $362,430. The reasons stated for the increased costs were: 1) more detailed technical analysis for inclusion in the Draft EIR; 2) responding to comments on the Draft EIR; and 3) assisting with and attending additional project meetings. The City's share of the amended costs are $181,215. Staff recommends that $185,000 be allocated to cover the City's share of these additional costs. This would bring the City's total contribution for the preparation of the EIR to $710,696. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the CEQA pursuant to Sections 15060 (c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). SUMMARY: John Wayne Airport (JWA) is requesting Board approval of Contract Amendment Number One to each of the following four Architect- Engineer (A -E) agreements for additional work on the Environmental Impact Report (EIR) and associated technical analyses for the proposed JWA Settlement Agreement Amendment: ENVIRON (Air Quality), Fehr & Peers (Traffic and Circulation), Landrum & Brown (Noise) and BonTerra Psomas (EIR Preparation). Additional work scope within each agreement is requested for 1) more detailed technical analysis for inclusion in the Draft EIR; 2) responding to comments on the Draft FIR; and 3) assisting with and attending additional project meetings. BACKGROUND INFORMATION: On April 16, 2013, the Board of Supervisors approved a Memorandum of Understanding (MOU) with the City of Newport Beach. This MOU identified that 50% of the proposed project costs would be reimbursed by the City. The remaining 50% will be funded by the John Wayne Airport Operating Fund. On September 10, 2013 the Board of Supervisors approved and executed A -E Agreements with five firms for the preparation of an Environmental Impact Report (EIR) and supporting technical studies. The FIR and technical studies identify the environmental impacts associated with a proposed 15 -year extension of the JWA Settlement Agreement. The original 1985 Settlement Agreement formalized consensus between the County of Orange, the City of Newport Beach, the Airport Working Group (AWG) and Stop Polluting Our Newport (SPON) on the nature and extent of facility and operational improvements that could be implemented at John Wayne Airport through 2005. In 2003, the original four agreement signatories approved a series of amendments to the Settlement Agreement that allowed for additional facilities and operational capacity and continued to provide environmental protections for the local community through 2015. Beginning in 2012, the four signatories contemplated a second extension to the Settlement Agreement. The parties subsequently reached agreement on the definition of a "proposed project" and project alternatives to be analyzed in the EIR pursuant to the California Environmental Quality Act (CEQA). Preparation of the draft technical studies and Draft FIR began in October 2013. The team of five A -E firms has worked on preparing a Draft EIR (DEIR) for public review, which includes very detailed technical studies, including aviation studies and extensive air quality, noise and traffic modeling to support the CEQA analysis of impacts and development of proposed mitigation measures. As part of the CEQA analysis, additional detailed technical work, as outlined in each AE agreement amendment is necessary, as well as the addition of a CEQA - compliant lesser impact alternative. As this EIR process progresses, and comments on the Notice of Preparation (NOP) and DEIR are evaluated, issues have arisen requiring additional, more detailed analyses. Specifically, data requests during the NOP and DEIR preparation process, including additional information requested by the public and the Settlement parties, have caused unanticipated additional A -E technical work to be performed in the areas of air quality, greenhouse gases, traffic, noise, land use and project alternatives. The additional work scope and budget are requested in order to be responsive to the environmental review process and the Settlement Agreement parties. The additional technical study work must also be added to the DEIR in summary form. As is typical, the DEIR, addressing the environmental impacts of the proposed project and alternatives, is made publicly available as part of the DEIR public review process, and includes all technical studies as appendices to the DEIR. It is anticipated that, given the complexity of the DEIR and technical analyses, questions and comments will be submitted during the DEIR review and comment period that will require additional hours and response efforts by the A -E technical experts.
