TITLE: Acceptance of 2014/2015 State of California, Office of Traffic Safety DUI
Enforcement, Awareness and Traffic Safety Programs Grant #PT15114
ABSTRACT:
The Police Department seeks acceptance of a grant totaling $350,045 from the State of California, Office of
Traffic Safety (OTS) to fund a Driving Under the Influence (DUI) Enforcement and Awareness Program,
traffic safety enforcement, and DUI Sobriety Checkpoints.
RECOMMENDATION:
a) Authorize the City Council to accept a $350,045 "Selective Traffic Enforcement Program" (STEP)
award granted to the Newport Beach Police Department by the OTS per Council Policies F -3 and F -25.
Therefore, to comply with Council Policy F -3, City Council must formally accept the award of $350,045 and
create a new appropriation to expend the money; and
b) Approve Budget Amendment No. 15BA -011 increasing Police revenue estimates and expenditure
appropriations by $350,045.
FUNDING REQUIREMENTS:
The Budget Amendment records and appropriates $350,045 in additional revenue from the OTS STEP
grant and $350,045 in increased expenditure appropriations. The revenue will be posted to the OTS STEP
FY 15 account, 127 -492C, and the expenditure appropriations will be posted to the various expenditure
accounts in Division 1278 of the OTS Fund, according to the following breakdown:
1278 -7041 Overtime: Safety $ 341,180
1278 -7425 Medicare Fringes 5,000
1278 -8100 Travel & Meetings 3,865
Total FY 15 STEP Grant $ 350,045

DISCUSSION:
The City of Newport Beach is a unique and dynamic community that is blessed to be located along the
scenic coastline of Southern California. The City and surrounding area are deeply rooted in history. The
City's natural waterway inlets were rest stops in the 1830's for weary East Coast whalers, and later into the
1930's, the town became a popular backdrop for Hollywood pirate movies. At approximately 51 square
miles, including areas of water, Newport Beach consists of rugged coastline, inland waterways, and has a
diverse mix of commerce, tourism, and distinct residential communities.
As charming as our town is, it is also a hot spot for Orange County night life. Newport Beach routinely
competes with other cities for the highest number of Department of Alcoholic Beverage Control licensed
establishments in the State of California (per capita). According to Alcohol- Sensitive Information Planning
System (ASIPS -GIS) data, Newport Beach has a population density three times that of the state average
for on -sale establishments. The population of Newport Beach is approximately 86,000 residents; however,
during the summer months, the City experiences an influx of transient population that can exceed 100,000
daily visitors. While this tourist population can benefit the city, it also stresses City infrastructure and
departments, including the Police Department.
Our first DUI - related grant was requested and awarded through OTS in 2007. Since then, the Department
has been dedicated to the reduction of DUI - related collisions, community education, and enforcement. The
City and Police Department continue to recognize the need for ongoing DUI enforcement and education.
The most recent data (2011) supplied from the California Office of Traffic Safety (OTS) revealed the City of
Newport Beach was in the top 10% of similar -sized California cities in several collision - related categories
per capita, including nighttime injury collisions, alcohol - involved collisions, and bicycle - involved collisions.
Newport Beach was also in the top 20% in motorcycle collision injuries per capita. Newport Beach markets
itself, among other things, as a "destination location" and attracts visitors from all over the region, state,
and world. Certainly, the daily increase in population, including people who don't live in Newport Beach,
but come to our city to work, shop, visit, dine, recreate, go to the beach or enjoy other water - related
activities, bicycle through or pass through on their way to another location, and for other reasons, is a
component of our current rankings. To provide ongoing enforcement and education to our residents,
businesses, and visitors, and to pursue increased roadway safety for all users, we would like to continue to
utilize OTS grant funding to combat DUI, DUI /Drugs, and alcohol - involved driving; distracted driving,
primary collision factors, motorcycle - related driving violations, and bicyclist, motorist, and pedestrian -
related violations.

The Newport Beach
California, OTS, to
enforcement in the
Police Department has applied for and has been awarded a grant from the State of
increase DUI Enforcement and Awareness and to fund additional traffic safety
City of Newport Beach. Grant number PT15114 ( "Selective Traffic Enforcement

Program ") will become effective October 1, 2014, and will expire September 30, 2015.
The grant funds will pay for overtime costs for officers specifically assigned to DUI enforcement and
awareness programs, including six DUI checkpoint operations, warrant service operations, stakeout
operations, and traffic enforcement operations related to distracted driving, motorcycle safety, and
bicycle /pedestrian enforcement operations. Interstate travel and training expenses are also included in the
grant for officers attending Standardized Field Sobriety, Advanced Roadside Impaired Driving, and Drug
Recognition Expert training. Almost all DUI efforts involve overtime, as they are unique and short-term
assignments that do not involve the personnel normally scheduled during DUI enforcement shifts. In other
words, we retain the same number of officers on patrol even as we have other officers work a DUI
enforcement activity.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQX) pursuant to Sections 15060
(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in
physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

Congratulations! Through a competitive process, the Office of Traffic Safety (OTS) has tentatively
approved your funding request for the proposal titled "Selective Traffic Enforcement Program (STEP)"
in the amount of approximately $350,045.00.
Your OTS Coordinator will contact you, to discuss your proposal and explain the Grant Agreement
process. It is our goal to have all new grants start no later than October 1, 2014. If approval fi-om a
City Council or the Board of Supervisors is required, you should begin that process now. Do not incur
grant reimbursable costs prior to the receipt of your official approval packet from OTS or before your
grant start date.
OTS will initiate a statewide media news release regarding 2015 proposals selected for funding. Your
agency should notpublically announce this tentative award until the grant agreement is fully
negotiated and signed by OTS.
