RECOMMENDATION: No action required. FUNDING REQUIREMENTS: No fiscal impact. DISCUSSION: Due to an error in publishing the public notice, the public hearing will be re -noticed for the October 14, 2014 City Council meeting. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Tuesday, September 23, 2014, at 7:00 p.m., a public hearing will be conducted in the City Council Chambers at 100 Civic Center drive, Newport Beach. The City Council of the City of Newport Beach will consider the following application: A -Frame Sign Regulations — An amendment to Title 20 (Zoning Code) of the Newport Beach Municipal Code to allow A -frame signs on private property in commercial zoning districts. NOTICE IS HEREBY FURTHER GIVEN The code amendment is categorically exempt under Section 15305, of the California Environmental Quality Act (CEQA) Guidelines — Class 5 (Minor Alterations in Land Use Limitations) because the commercial properties involved have an average slope of less than 20 percent; and the and proposed amendment would not result in any changes in land use or density. This code amendment is also categorically exempt under Section 15311 of the CEQA Guidelines — Class 11 (Accessory Structures), which exempts the construction, or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including on -premise signs.
