AYES: NOES: ABSENT: ABSTAIN PUBLIC HEARING ITEMS: Brown, Koetting, Myers, and Tucker None None Hillgren, Lawler, Kramer ITEM NO. 2 Balboa Marina West MIND (PA2012 -103) Site Location: 151 and 201 Coast Hwy E SUMMARY: On the basis of the Initial Study, City staff has concluded that the Balboa Marina West Project would not have a significant unavoidable impact on the environment and has therefore recommended preparation of a Mitigated Negative Declaration (MND). The Balboa Marina West Project is a proposal to construct a new public boat dock in Lower Newport Bay and improve and expand the existing Balboa Marina. The new public dock would include a gangway and 12 public boat slips including 8 new slips and 4 slips that would be relocated to the public dock from the existing private Balboa Marina. In the private Balboa Marina, 24 private boat slips and a new gangway are proposed. In the land -side area of the marina, the Project proposes to demolish the existing Balboa Marina parking lot and a 1,200 SF building located at 201 East Coast Highway. In their place, a reconfigured parking lot and 19,400 SF marine commercial building is proposed to house a yacht brokerage office, public restrooms, and a restaurant. CEQA COMPLIANCE: See Summary above. NE City Council Staff Report Page 2 Planning Program Manager, Patrick Alford, gave a presentation summarizing the MND process. Consultant, Tracy Zinn, provided an overview of the impacts and mitigation measures, and detailed comments received and their responses. The Planning Commission voted unanimously to approve the Mitigated Negative Declaration (7 ayes). AYES: Brown, Hillgren, Koetting, Kramer, Lawler, Myers, and Tucker NOES: None ABSENT: None ABSTAIN: None ITEM NO. 3 Balboa Village Design Guidelines Update (PA2014 -141) Site Location: Balboa Village between Adams Street and A Street SUMMARY: The Balboa Village Design Guidelines were adopted in 2002. An update to the Guidelines is proposed to make them more user - friendly and to provide examples of fagade improvements. CEQA COMPLIANCE: The proposed action is not defined as a project and does not require environmental review under the California Environmental Quality Act (CEQA) because it involves general policy and procedure making activities not associated with a project and does not have the potential for resulting in a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment (Section 15378 of the CEQA Guidelines). The adoption of design guidelines does not authorize any specific development or project and would only provide non - regulatory design guidance for future projects that would be subject to CEQA. Deputy Community Development Director, Brenda Wisneski, provided a staff report, and discussion ensued requesting additional changes to the document. The Planning Commission voted unanimously to recommend to the City Council approval of the update to the Guidelines (7 ayes). AYES: Brown, Hillgren, Koetting.
