Brown, City Clerk PHONE: (949) 644 -3005 TITLE: Appointment of a New City Arts Commissioner to Fill an Unscheduled Vacancy ABSTRACT: Due to Michaell Magrutsche's resignation, the City Council may appoint a person to fill the position vacated by Mr. Magrutsche on the City Arts Commission. RECOMMENDATION: Appoint one of the persons that submitted an application to the City Arts Commission to fill the unexpired balance of Michaell Magrutsche's term, which expires on June 30, 2017. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: On August 11, 2014, Commissioner Michaell Magrutsche resigned from his seat on the City Arts Commission, due to his relocation outside of Newport Beach. His term is scheduled to expire on June 30, 2017. Section 702 of the City Charter provides, in part, "the members of [the Arts Commission] shall be appointed by the City Council from the qualified electors of the City... ... Charter Section 705 provides, in part, "if a member of a board or commission... ceases to be a registered elector of the City, his or her office shall become vacant and shall be so declared by the City Council." Pursuant to Charter Section 702 and City Council Policy A -2 (Board, Commission, and Committee Appointments), the City Council's appointee to the City Arts Commission will serve the remainder of Mr. Magrutsche's unexpired term. The City Council declared the vacancy on the City Arts Commission at its September 9, 2014, City Council meeting. Pursuant to the Maddy Act and City Council Policy A -2, the City Clerk prepared and posted the Special Vacancy Notice on Tuesday, August 12, 2014, in the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers. The Special Vacancy Notice was also placed on the 15 -1 City's webpage on Tuesday, August 12, 2014, and was published in the Daily Pilot on Saturday, August 16, 2014. As per the Special Vacancy Notice, applications were accepted by the City Clerk's Office until noon on Friday, September 19, 2014. Ten (10) applications were received by the City Clerk's Office and are attached hereto as Attachment A. Appointment Process Pursuant to City Council Policy A -2, appointments to the City Arts Commission will take place in the following manner: A. The City Council will vote on all appointments simultaneously. The voting will be done by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast one vote on the paper ballot. In order to be appointed, an applicant must receive at least four votes. ENVIRONMENTAL REVIEW: This action is not subject to the California Environmental Quality Act ( "CEQX) pursuant to Sections 15060 (c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). To whom it may concern, I have been involved with the arts since I can remember. As a child, I performed in our local community theatre, in college I worked in our costume shop. As an adult, my life revolves around the arts. My passion is supporting "all things live and local ". As a board member(and actor and producer) of a local community theatre, I have been able to experience first hand what it takes to bring a show to life. Newport Beach has a wealth of opportunities with both fine and performing arts. I have also worked for many years on the fund raising side for several different organizations. My grandfather, Lyell Loomis Buttermore, first began painting watercolors alongside Rex Brandt some 65 years ago as a CdM resident. With the exception of being away at school, I am pleased to say that Newport Beach has been home to both sides of my family for over three (3) generations. I first picked up a Super 8 camera when the ear doctor told me I couldn't go in the ocean anymore to surf. When my friends who surfed and snowboarded became sponsored, I followed with a camera. This took me around the world as both a photographer and cinematographer for VOLCOM for more than 7 years. I've also been fortunate to work with three Academy Award nominated film directors such as Greg MacGillivray, Bailey Sileck, Darren Aronofsky who directed "BLACK SWAN" and "NOAH" as well as Newport's own McG. My transition from film to architecture began in my twenties while acquiring my first master's degree as a means to serve the family legacy which my Popop began many years ago. I had an amazing ten year run editing movies and directing music videos & commercials but in my humble opinion, there is nothing like building a building. I completed my 2nd masters (in architecture) a full year early whereas today, I am 34 and am priveleged to serve as a design consultant for many of the top firms here in the city. Just last month, I finished the updated facade design for the Laguna Beach Festival of the Arts on behalf of Bauer Architects which begins construction this fall immediatley after the Pageant of the Masters. I am applying to volunteer for the city which serves as my home as I have truly enjoyed doing so for Santa Ana's Public Art Commitee, I enjoy the comradery and I enjoy helping with matters which I work in daily. I also would like to give back to the city which has provided me with so much. I am a firm believer in art as a vehicle to inspire, particularly the youth of this city which we call home. In college I ran the University Center's Art Gallery and was a member of the student council. I have alway had an interest In art, design and aesthetics. I am so impressed with our city and how h keeps evolving and would love to be able to contribute in some way. I like the new City Hall and open space areas and find the art surrounding it very interesting. My background as a tv commercial and photo shoot producer, I feel, would make me an ideal candidate. My children had the benefit of a top quality education in the Newport Mesa School District. And as an active volunteer within the community over the last 14 years, I embrace the philosophy that it takes a village to raise a child. Now that my two sons are heading off to Stanford and Cal Poly San Luis Obisbo in the fall, my energy and enthusiasm can be delegated to areas which I am quite passionate. I am a fifth generation Californian and believe in honoring this legacy and pioneering spirit of my ancestors. Bringing more culture and civic awareness to our City is essential to our well- being, and to maintain and improve property values, a fact that was embraced by the City Council with their recent focus on public art. I have experience working with all levels of government, businesses (both large and small), non - profits and community /civic leaders and have extensive contacts with them all. Additionally, I have worked for, and with, elected officials who have represented constituencies greater than 500,000 people. This has taught me how to interact and work with people whom may disagree with you philosophically but can come to the consensus that the common goal is greater than our differences.
