HomeMy WebLinkAbout04 - Active Military Duty ResolutionCITY OF NEWPORT BEACH ADMINSTRATIVE SERVICES DEPARTMENT Resource Management Division May 24, 1999 May 24, 1999 Agenda Item No. 4 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Dennis Danner, Administrative Services Director SUBJECT: RESOLUTION AUTHORIZING SUPPLEMENTARY SALARY AND BENEFIT PAYMENTS TO CITY EMPLOYEES CALLED TO ACTIVE MILITARY DUTY DISCUSSION: The City is currently aware of at least two employees who are Military Reservists who may be asked to report for active Military duty. In order to deal promptly and effectively with their employment issues if this should occur, the attached resolution has been prepared for your approval. It meets and exceeds State law requirements for treatment of those reservists called to active military duty. In 1991 the City established a similar policy to handle the Persian Gulf crisis. However, in the current Resolution we have included more detail about the implementation of these obligations, such as how to coordinate the 30 days of full salary as required by State law with the 180 days of supplemental pay. In addition, we have provided more detail on how and when an employee is eligible for this benefit. Our current Personnel Rules contain one reference to military leave and it simply refers to our obligation to enforce the State of California Military and Veterans Code. Again, this Resolution will provide more guidance in managing this issue for our employees. If these reservists are called to active military duty the City would supplement their military pay to provide them with the equivalent of their full City pay. In addition, the City would continue their City benefits including leave accruals. RECOMMENDATION: It is recommended that the City Council approve the attached Resolution for supplementary pay and benefits for City employees called to active military duty for a period in excess of 30 days. 0 RESOLUTION NO. 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING SUPPLEMENTARY SALARY PAYMENTS TO CITY EMPLOYEES CALLED TO ACTIVE MILITARY DUTY. WHEREAS, the City Council supports the U.S. military mission and deeply appreciates the role military reservists play in resolving conflict; and WHEREAS, the City Council finds that the provision of supplemental pay to reservists called to active duty, serves the public interest by creating a strong incentive on the part of these experienced employees to maintain their positions with the City of Newport Beach during and after a conflict; and WHEREAS, the supplemental salary and benefits conferred by this Resolution exceed the minimum support required by State law; NOW THEREFORE BE IT RESOLVED: Section 1. Any officer or full time employee of the City of Newport Beach who, as a member of the California National Guard or United States military reserve organization, is called into active duty, shall receive from the City, for a period not to exceed 180 days, compensation equal to the difference between his or her military pay and the base pay the officer or employee would have received, including any merit raises and accrued leave, he or she would have received if not called to active duty. For employees eligible for thirty (30) days full pay, the 180 days supplemental pay will begin on the 31" day of active service. For employees not eligible for thirty (30) days full pay, the 180 days supplemental pay will begin on the 1` day of actual service. No supplemental compensation shall be paid if military pay exceeds the reserve member's base pay as a City employee. This benefit shall not apply to any active duty served voluntarily after a designated conflict. Section 2. The supplemental compensation granted by Section 1 of this Resolution shall be in addition to the following benefits currently provided to officers and employees who are members of the reserves: A. For employees with one year or more City employment, payment of full salary when called to active duty for up to thirty (30) days per fiscal year; 0 during active duty; and B. Payment of all benefits for employees and their dependents C. Restoration of former position upon return from active duty; D. Accrual of all benefits during absence and while on active duty including, without limitation, vacation, sick leave, retirement service credit, and service credit for purposes of merit increases. Section 3. For purposes of this Resolution, the term "military pay" shall include all compensation received by the reservist during, or as a result of the call to, active duty, including, without limitation, call up pay, extra hazardous duty pay, housing allowances, and specialty pay. Section 4. The provisions of this Resolution shall take precedence over the provisions of any other resolution relative to the compensation or benefits paid to employees or officers of the City of Newport Beach.
