If desired, (a) adopt a resolution ordering the vacation and abandonment of a 15 foot width of right -of -way along West Ocean Front adjacent to 6200 West Ocean Front as shown in the attached Exhibit "A "; and (b) direct the City Clerk to have the resolution recorded in the office of the County Recorder concurrently with the 15 foot wide alley Grant of Easement provided by the owner of 6200 West Ocean Front once required deposits and sureties have been provided by Mr. Craig Atkins. i3. Approve the construction of a drive approach on 62nd Street suVect to the owner depositing the sum of $4,000.00 towards the construction of 62 Street street -end improvements. DISCUSSION: The property owner at 6200 West Ocean Front, Mr. Atkins, has requested that a 15 -foot width of excess right -of -way along the West Ocean Front frontage be abandoned by the City in exchange for a 15 -foot alley dedication and construction of alley improvements. In the 1980's the City entered into similar agreements with the property owners along West Ocean Front between 62nd Street and 63d Street in order to provide alley access to the properties fronting West Ocean Front. The last parcel requiring dedication to complete the alley between 62nd Street and 6e Street is 6200 West Ocean Front. As a condition of the vacation, the City shall require that -the owner, Mr. Atkins, provide the City with a fully executed copy of a Grant Deed for the 15 foot alley dedication, and that he provide a surety to guarantee completion of the alley improvements. The alley dedication and West Ocean Front vacation shall be recorded concurrently. In addition, Mr. Atkins is requesting vehicular access from 62nd Street in -lieu of providing alley access. Street access will require that the street -end be extended to provide enough backing room from his proposed garage access. 40 The 62nd Street street -end is scheduled to be reconstructed during FY1999 -2000. July 12, 1999 Page 2 Works Department will require that the owner deposit an amount equivalent to the cost of the of curb, drive approach and pavement patching prior to vacation of the West Ocean Front right -of- way. It is anticipated that the cost of these improvements will be about $4,000.00. In addition, the Public Works Department will require the owner to remove the portion of block wall presently encroaching into the 62nd Street right -of -way. The City is requiring Mr. Atkins to pay for the construction of approximately 30 feet of the 62 "d Street street -end improvements in front of his proposed garage with access from 62 "d Street because the street -end must be extended to provide backing room to exit from his proposed garage and for on- street parking. City Council Policy L -2 states that curb cuts shall not be permitted to residential property which abuts an alley, unless existing structures prevent full alley access or additional covered off- street parking is being provided. Letters have been sent to the Southern California Edison Company, Pacific Bell and the Southern California Gas Company. Staff does not anticipate that any of the above utilities have facilities in the area of West Ocean Front to be abandoned. The subject West Ocean Front right -of -way is unnecessary for present or prospective public street purposes. A Notice of Vacation was published for 2 successive weeks prior to the hearing in the official newspaper of the City of Newport Beach. At least 2 weeks before the day of the hearing, at least 3 notices of the proposed vacation were conspicuously posted along West Ocean Front, not more than 300 feet apart. The notices stated the day, hour and place of the hearing. Adoption of the recommended Council resolution will complete the statutory proceedings to vacate and abandon the portion of West Ocean Front adjacent to 6200 West Ocean Front. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION AND ABANDONMENT OF A PORTION OF WEST OCEAN FRONT RIGHT -OF -WAY ADJACENT TO 6200 WEST OCEAN FRONT (WEST NEWPORT AREA); AND DIRECTING THE CITY CLERK TO RECORD SAME WITH THE COUNTY RECORDER'S OFFICE WHEREAS, the City Council of the City of Newport Beach, pursuant to the provisions of the Street Vacation Act (Section 8300 et seq. of the Streets & Highways Code) is authorized to vacate portions of public rights -of -way ; and WHEREAS, the City Council of the City of Newport Beach has reviewed and considered the various elements of the General Plan of the City of Newport Beach prior to declaring its intent to vacate a portion of this public right -of -way and has determined that the proposed vacation is consistent with the General Plan which shows no future use of right -of -way on any plans and right -of -way is unnecessary for present or prospective public street purposes; and WHEREAS, the City Council of the City of Newport Beach desires to vacate the portion of West Ocean Front, legally described in Exhibit °A° and depicted on the map attached as on Exhibit °B, the vacation to be processed pursuant to the provisions of the Street Vacation Act; and WHEREAS, that a notice of intention was published for at least two (2) successive weeks prior to the hearing in the official newspaper of the City of Newport Beach; and WHEREAS, that at least two (2) weeks before the day set for hearing, notices of the proposed vacation were conspicuously posted along West Ocean Front, with the notices posted not more than three hundred feet (300') apart and a minimum of three (3) notices posted on each street. The notices stated the day, hour, and place of the hearing. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this resolution recorded by the Orange County Recorder.
