Background The City does not paint street addresses on curb faces. Newport Beach Municipal Code Section 12.20.080 limits the painting of streets or curbs to those authorized by the City, except for the painting of numbers on curbs. This section also requires anyone painting numbers on curbs to comply with the provisions of any City resolution or ordinance pertaining to such acts. Other than Section 12.20.080, the City does not have a resolution or ordinance regulating the painting of street numbers on curb faces. The City does not require curb number painting service providers to obtain prior permission from the resident, nor has the City established standards relative to the size or color of the numbers to be painted. Approximately every two years, businesses circulate through the City providing street curb painting services to residents. Prior to plying their trade in the City, these businesses routinely contact the Revenue Division to determine any requirements the City may have on their business conduct. Unless operating as a non - profit organization, curb number painting service providers are required by Chapter 5.04 to obtain a business license (a non - regulatory process). Routinely these companies solicit their services by distributing circulars in residential districts indicating their company (or non -profit organization) will be painting their street address on the curb face on a particular day, and suggests payment (or donation) will be retrieved from the resident on that day after the numbers have been painted. While some curb painting service providers will not paint the street numbers on the curb face if the resident asserts their request not to have their numbers painted (usually by taping the circular to the curb face), most paint the numbers whether or not the resident desires the service. 0 0 This year, two curb painting service providers were simultaneously providing services to City residents. Their competition in providing this service contributed to the significant number of complaints Police, Traffic Engineering, City Attorney and Revenue Division staff received regarding their business practices. Resident's complaints ranged from not desiring their numbers being painted to having the wrong numbers painted. The Police Department dispatched officers to at least two incidents involving street number curb painters during the month they were operating in the City. Discussion The Police Department, Traffic Engineer, City Attorney's Office and the Revenue Division have reviewed the proposed standards for the painting of street addresses on curb faces, and believe they will reduce the number of complaints regarding these services. Attachment: Proposed Resolution 9 I* RESOLUTION NO. 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING REGULATIONS FOR PAINTING STREET NUMBERS ON CURBS WHEREAS, Newport Beach Municipal Code Section 12.20.080 prohibits the painting of any street or curb surface except the painting of numbers; and WHEREAS, Newport Beach Municipal Code Section 12.20.080 requires any person painting numbers on a curb surface to comply with the provisions of any resolution or ordinance pertaining to painting numbers on a curb surface; and WHEREAS, no resolution or ordinance of Newport Beach Municipal Code currently establishes standards for painting street numbers on curb surfaces; and WHEREAS, the City Council desires to establish standards and regulations for painting street numbers on curb surfaces. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Newport Beach as follows: 1. Residents and property owners may paint street numbers on curbs adjacent to the resident or property owner's property. All street numbers shall be painted on curb surfaces in minimum three -inch (3 ") numbers in black on a white background. 2. No other person shall paint street numbers on curb surfaces without prior written approval of the property owner or resident living at the street number to be painted, or written contract with the City of Newport Beach to paint street numbers.
