SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. (Red light signifies when three minutes are up; yellow light signifies that the speaker has one minute left for summation.) ITEM NO. 1. SUBJECT: 407 Bolsa Avenue Vance Collins and Ian Fettes, applicants (Continued Planning Commission discussion from November 4, November 18, and December 9, 1999) SUMMARY: Request for a General Plan Amendment to change the land use designation from Retail and Service Commercial (SP -9) to Two - Family Residential, to allow for the construction of attached two - family residential subdivision. The application includes: • amending Specific Plan No. 9 to remove the two lots from the plan, • amend Districting Map No. 25 to rezone the property to the R -2 -PRD District, • a use permit for a planned residential development, • • a variance to waive PRD Overlay District property development regulations related to lot coverage, the requirement that the development shaii be bounded on all sides by public streets, and on -site guest parking, N REQUIRED ACTION: • a tentative tract map to create six parcels and allow them to be used for condominium purposes, • a modification permit to allow: ➢ a 2 foot encroachment into the 4 foot side yard setbacks with a fireplace woodbox, and ➢ a 2 foot 6 inch second floor building encroachment into the rear 10 foot setback area, and ➢ property line walls ranging from 6 feet up to 12 feet in height in the front and side setback areas where the Code limits the height of walls and fences to 3 feet in the front setback and 6 feet in the side and rear setbacks; and • an exception from the requirements of Seciton 19.20 of the Subdivision Code (Design Standards), to allow the creation of commercial lots without the required 30 foot alley at the rear of the property and the creation of one lot that does not abut a street. SUBJECT: Dolin Residence Retaining Wall (Peter D. Brandow, applicant) 1541 Dolphin Terrace (Continued Planning Commission discussion from December 9, 1999) SUMMARY: Request to permit the construction of a 15 foot high rear yard retaining wall with a 3 foot guardrail on top, which exceeds the permitted 6 foot height limit in the side and rear yard setback areas. The proposed retaining wall is intended to stabilize an unsafe slope and reclaim a portion of rear yard lost due to erosion. The retaining wall will reclaim approximately 29 feet of rear yard surface area which previously was slope. REQUIRED Hold public hearing: ACTION: Approve, modify or deny: • Modification Permit No. 4968, and the . • Acceptance of a Negative Declaration R IF ITEM NO. 3. • SUBJECT: Haggstrom and Lakes Residences (Rodney Lee Haggstrom, applicant) 301 and 305 Alvarado Place SUMMARY: Amendment to revise Districting Map No. 11 to establish an 8 foot front yard setback on Alvarado Place in conjunction with the construction of a new single family dwelling at 301 Alvarado Place. The two lots are currently developed fronting on Alvarado Place and the Districting Map establishes East Bay Avenue as the front of the comer lot. REQUIRED Hold public hearing; ACTION: Approve, modify or deny: • Amendment No. 896 ITEM NO. 4. SUBJECT: 1995 Shores Partners, L.P. (Tim McSunas, applicant) 900 Sea Lane (Continued Planning Commission discussion from December 9, 1999) SUMMARY: Request to subdivide an existing lot. containing 7.5 acres of land into a single parcel of land in conjunction with the development of an 89 unit attached and detached residential condominium project on property located in the MFR District (Multi - Family Residential). Also included is a request for a modification to allow detached structures to be built 6 feet apart, where the Code requires 10 feet minimum. SUBJECT: Newport Dunes Resort Draft Environmental Impact Report SUMMARY: Follow -up on information requested by the Planning Commission during previous study sessions on the Newport Dunes Resort Draft Environmental Impact Report (DEIR). Item 2 regarding Dolin Residence Retaining Wall (Modification Permit No. 4968 and the Acceptance of a Negative Declaration) was continued at the applicant's request to February Yd (all ayes). Item 3 regarding the Haggstrom and Lakes Residences (Amendment No. 896) was recommended for approval and is automatically forwarded to the City Council (all ayes). Item 4 regarding 1995 Shores Partners, L.P. (Tentative Tract Map No. 15829, Modification Permit No. 5002 and Acceptance of a Negative Declaration) was approved and is subject to appeal or call up by the City Council (all ayes). Item 5 regarding the Newport Dunes Resort draft environmental report was discussed and scheduled for public hearing at the Planning Commission meeting of January 20, 2000. Item 6 regarding a status report on Twin Palms Restaurant use permit review was provided and discussed.
