Harkless, City Clerk SUBJECT: AMENDMENT OF CHAPTER 1.30 OF THE MUNICIPAL CODE RECOMMENDATION Introduce Ordinance No. 2000 -_ amending Section 1.30.030 of Title 1 of the NBMC pertaining to election campaign filing, and pass to second reading on June 13, 2000. • BACKGROUND During the 1995 General Municipal Election some confrsion arose surrounding the filing of copies of campaign documents with the City Clerk in the fourteen (14) days preceding the election. The code section requires that ten (10) copies of the campaign documents be filed within two hours of first distribution, however there was no requirement to provide proof of the first distribution. Without this requirement it was virtua'.ly impossible to determine whether the documents were being filed in the timefrlme provided. The City Attorney has drafted an amendment to the ordiliance which requires that within two hours after distribution of the first document, ten (10) copies of the campaign document must be filed with the City Clerk accompanied by a Notice of Mailing or other evidence confirming the date and time of the first distribution. This provision will apply to each initial distribution of more than two hundred substantially similar campaign documents but shall not apply to any distribution of campaign documents after copies have already been filled with the City Clerk. Harkless, CMC /AAE City Clerk • Attachment: Draft Ordinance F: \Users \Clk \L iwkless \Miscellaneous\ 2000\ CampaignFilingOrdReport5- 23- OO.rtf ORDINANCE NO. 2000 -_ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 1.30.030 OF TITLE 1 OF THE NEWPORT BEACH MUNICIPAL CODE, PERTAINING TO ELECTION CAMPAIGN FILING The City Council of the City of Newport Beach does hereby ordain that certain Newport Beach Municipal Code section is amended to read, in full, as follows: SECTION 1: Section 1.30.030 of Chapter 1.30 is amended to read as follows: 1.30.030 Filing. Any person distributing two hundred (200), or more, substantially similar campaign documents within fourteen (14) days of any general or special municipal election shall, within two hours after distribution of the first document d;StFibUtiOn, file ten copies of the campaign document with the City Clerk accompanied by a Notice of Mailing or other evidence confirming the date and time of the first distribution. The provisions of this Section shall apply to each initial distribution of more than two hundred substantially similar campaign documents but shall not apply to any distribution of campaign documents after copies have been filed with the City Clerk. SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this -a • ordinance. The City Council hereby declares that it would have passed this 11 ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. SECTION 4: This ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach, held on the 23rd day of May, 2000, and adopted on the 13th day of June, 2000, by the following vote, to wit: AYES, COUNCILMEMBERS NOES, COUNCILMEMBERS ABSENT COUNCILMEMBERS MAYOR ATTEST: • City Clerk 2
