RE: STAFF SUPPORT FOR THE ARTS FOUNDATION
ISSUE
Should the City Council grant Don Gregory's request for staff support for the
Arts Foundation?
RECOMMENDATION
Based on Council Policy A -5, the City Manager recommends Council deny Mr.
Gregory's request to utilize a City staff member unless Council believes an
exception to this policy is warranted.
BACKGROUND
Council Policy A -5 establishes guidelines for fundraising by City boards,
commissions or committees and also requires boards, commissions or
committees to obtain Council permission to enter into contracts. The Arts
Foundation is not a board, commission or committee established by the City
Council or Charter; it is a non - profit organization with no affiliation to the City
Council. As Don Gregory says in his written request, the Arts Foundation will
be the group doing the fundraising for the Arts and Education Center. Having
City staff support for the Arts Foundation could appear to erode the
independence of the Foundation. Mr. Gregory is making this request as a
member of the Cultural Arts Commission, as he is not a board member of the
Arts Foundation.

Subject: City Staffing fbr Arts Foundation
I would respectfully like to suggest that the City Council re- instate at least one person to
the Arts Foundation This staffing was recently removed and, in my opinion, just as a
new, revitalized and increasingly important Arts Foundation was convened
The advent of an Ad Hoc committee to determine the usage. for the parcel of land
abutting the Central Library, where an Arts and Education Center may be placed and the
continuing work of the Arts Foundation in supplementing Grant monies for the
enlightenment and education of our city's children must certainly be taken into
consideration when determining the level of help this foundation needs.
Every question asked about the proposed Center is the way the money will be raised
and by whom? Since the answer is the Arts Foundation I feel that it should have at least
a secretary and be an officially recognized body, as it was only two months ago.
This has nothing to do with the raising of funds at all.

FUND RAISING /CONTRACTS BY CITY
BOARDS, COMMISSIONS OR COMMITTEES
PURPOSE
A -5
To establish the policy for fund raising or contracts for boards, commissions, or
committees, established by the City Charter or the City Council.
POLICY
Fund Raising. No board, commission, or committee which has been established by the
City Charter or by the City Council, shall have the authority to independently raise and
collect funds on behalf of itself, any other board, commission, committee, or the City.
Any such funds shall be generated by and collected through legally established
non rofit groups and organizations which are independent of the City. An exception to
this policy may be granted by the City Council on a per project basis when
circumstances justify the exception.
Contracts. No board, commission or committee which has been established by the City
Charter or by the City Council, shall have the authority to enter into any contract with
any agency, group, entity or individual without authorization from the City Council.
