HomeMy WebLinkAbout17 - Weed AbatementAugust 8, 2000 Council Agenda Item No. 17 TO: Mayor and Members of the City Council FROM: Tim Riley, Fire Chief �fV SUBJECT: 2000 Annual Weed and other Nuisances Abatement RECOMMENDATIONS: Hold a public hearing on August 8, 2000, to consider objections of any property owners whose property is subject to cleaning by the City appointed contractor. Adopt a resolution ordering the Fire Chief to abate weeds and other nuisances identified to be existing upon streets, alleys, sidewalks, parkways, and private property within the City. Schedule a public hearing on October 10, 2000, to confirm assessments against those properties cleaned by the City. DISCUSSION: Resolution 2000 -56, adopted on June 27, 2000, declared that weeds and other public nuisances existing upon streets, alleys, sidewalks, parkways, and private property within the City be abated. Fire Department staff has identified the following properties, which are in need of cleaning. All affected property owners have been notified of this public hearing by mail. RESOLUTION NO. 2000- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE FIRE CHIEF TO ABATE WEEDS AND OTHER PUBLIC NUISANCES EXISTING UPON STREETS, ALLEY, SIDEWALKS, PARKWAYS, AND PRIVATE PROPERTY WITHIN THE CITY. WHEREAS, on June 27, 2000, The City Council of the City of Newport Beach adopted Resolution No. 2000 -56 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING THAT WEEDS AND OTHER PUBLIC NUISANCES EXIST UPON STREETS, ALLEYS, SIDEWALKS, PARKWAYS, AND PRIVATE PROPERTY WITHIN THE CITY, DECLARING THAT SAID WEEDS AND PUBLIC NUISANCES MUST BE ABATED, SETTING THE TIME AND PLACE FOR A PUBLIC HEARING AT WHICH THE CITY COUNCIL WILL CONSIDER PROTESTS FROM PERSONS OBJECTING TO THE PROPOSED DESTRUCTION OR REMOVAL OF SUCH PUBLIC NUISANCES BY THE CITY AND DIRECTING THE FIRE CHIEF TO GIVE NOTICE OF THE PASSAGE OF THIS RESOLUTION AND OF THE PUBLIC HEARING SET FOR AUGUST 8, 2000. Pursuant to the authority contained in Chapter 10.48 of the Newport Beach Municipal Code; and WHEREAS, the City Council has held a hearing to consider all protests to the proposed destruction or removal of the weeds and other public nuisances described in Resolution No. 2000 -56 and has taken final action as to all such protests in accordance with Section 10.48.060 of the Newport Beach Municipal Code. NOW, THEREFORE, BE IT RESOLVED: Section 1. The Fire Chief is hereby directed to abate such weeds and other nuisances as described in Resolution No. 2000 -56 or cause the same to be abated, by having the same destroyed or removed. Section 2. Any property owner shall have the right to destroy or remove such weeds and other nuisances himself, or have the same removed at his own expense, CO- provided that such weeds and other nuisances shall have been removed to the satisfaction of the Fire Chief prior to the arrival of the Fire Chief or his authorized representative to remove them. Section 3. NOTICE IS HEREBY GIVEN that on Tuesday, October 10, 2000, at the hour of 7:00 p.m., a public hearing will be held in the City Hall Council Chambers, 3300 Newport Boulevard, to consider and confirm the report and assessment list for abatement of weeds and other nuisances. Any and all persons interested and having any objections to said report and assessment list, or to any matter or thing contained therein, may appear and be heard at said time and place. Section 4. NOTICE IS HEREBY FURTHER GIVEN that on Thursday, September 28, 2000, copies of the report and assessment list will be posted on the bulletin board located outside of the City of Newport Beach Administration Building, 3300 Newport Boulevard, Newport Beach, and will also be available at the City Clerk's office or at the Fire Department.
