HomeMy WebLinkAbout19 - Taste of Newport BannersAugust 22, 2000 CITY COUNCIL AGENDA ITEM NO. 19 TO: Mayor And Members Of The City Council FROM: Public Works Department SUBJECT: "TASTE OF NEWPORT" BANNERS RECOMMENDATION: Approve the request of Newport Harbor Area Chamber of Commerce for the installation of 155 banners and 126 flag banners from August 23, 2000 to September 22, 2000. Installation shall be along Newport Center Drive, Newport Center Drive East/West ( "ring road "), MacArthur Boulevard, San Joaquin Hills Road, Jamboree Road, Westcliff Drive, Newport Boulevard, and East Coast Highway. DISCUSSION: Newport Harbor Area Chamber of Commerce ( NHACC) has requested permission to install 155 banners and 126 flag banners (63 double flag banners from August 23, 2000 to September 22, 2000 in the Fashion Island area for the 12 annual "Taste of Newport." The banners will be mounted on streetlight poles along the Newport Center Drive center median (26 flag banners), Newport Center Drive East/West "ring road" center median (100 flag banners), MacArthur Boulevard (34 banners), San Joaquin Hills Road (13 banners), Jamboree Road (35 banners), Westcliff Drive (9 banners), Newport Boulevard (22 banners), and East Coast Highway (42 banners). On the weekend of September 15 -17, 2000, NHACC will host the 12th annual "Taste of Newport" — a dining and entertainment celebration highlighting the many restaurants in Newport Beach. The Chamber reports that over 70,000 people attend the 'Taste of Newport" events. Attendees will pay a $12 admission charge to enter the event and can purchase food and drink from participating restaurants and caterers. The Costa Mesa based 'Times Orange County" has been the co- sponsor and underwriter of 'Taste of Newport" for ten consecutive years. To recognize the newspaper's role, the Chamber has designed a 2 -foot by 7 -foot banner that includes the 'Times" logo on the top of the banner. SUBJECT: "Taste Of Newport" Banners August 22, 2000 Page 2 The event is not co- sponsored by the City of Newport Beach, not free to the public, and does not exclude advertisement of the sponsor (Times) as required per City Council Policy L -16. Council Policy L -16 prohibits the use of a commercial sponsor's name on the banner. Staff notes that this sponsor is a commercial newspaper. However, the event will be community -wide, open to the public, and may create additional revenue to the City through restaurants, businesses, and hotel reservations. The applicant's request to install 281 private banners will exceed the 100 banner limit and the single banner per pole concept allowed per City Council Policy L -16. In the past, the following similar requests have been approved by the City Council for "Taste of Newport" (approved July 13, 1998 and August 23, 1999) and Orange County Museum of Art (approved October 12, 1998). In addition, the applicant has requested to install the banners on August 23, 2000 earlier than the September 1st date allowed per City Council Policy L -16. A similar request was previously approved by City Council for "Taste of Newport" (August 23, 1999). Although the double flag banners are 2 banners per pole at 3.83 -feet wide by 5.83 -feet high (44.66 square feet) and are 198 percent larger than the banner area (15 square feet) allowed per City Council Policy L -16, they are "free flying" and pose very little problems to street light poles during strong winds. Should the City Council elect to approve the installation of 281 banners in the Fashion Island area from August 23, 2000 to September 22, 2000, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles. On Newport Center Drive (from East Coast Highway) and Newport Center Drive East/West (Ring Road) the locations shall be limited to the center median. Two flag banners will be installed per each pole. 3. The applicant must provide on -going maintenance of the banners and brackets. 4. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 5. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a financial size category of "VIII" or higher. 6. Issuance of an Encroachment Permit by the Public Works Department. 7. The banners shall conform to City Council Policy L -16 with the exception of the number of banners, advertisement of sponsor, open to the public free of charge, and co- sponsor by the City. All banners and brackets shall be removed by the end of the approved time unless otherwise approved by the conditions stated in the Encroachment Permit. 9. All banners and brackets shall comply with the Encroachment Permit conditions. 10. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. 11. Issuance of an Encroachment Permit by the Department of Transportation. 12. The printed font of the sponsor, 'Times ", shall be the same size or smaller than the "Taste of Newport".
