To the north: Are commercial and residentially zoned properties and uses. To the east Are residential uses. To the south: Across Bolsa Avenue along both sides of Broad Street are residential uses. To the west: Are commercial uses fronting on Old Newport Boulevard and Bolsa Pork. �ry . yP 1, s', Page 2 Background On January 25, 2000 the Newport Beach City Council approved General Plan Amendment 91 -2, Amendment 894, Variance 1235, Use Permit 3668, and Tentative Tract Map 15981. • General Plan Amendment # 91 -2 changed the land use designation from Retail Service Commercial to Two - Family Residential. • Amendment 894 was approved to reclassify the property from the SP -9 (RSC) District to R -2 -PRD District and remove the two lots from Specific Plan #9 (Old Newport). • Variance #1235 was approved to waive PRD Overlay Disrtict property development regulations related to lot coverage and the requirement that the development shall be bounded on all sides by public streets. • Use Permit #3668 was approved to create a Planned Residential Development Overlay District. • Tentative Tract Map 15981 authorized the construction of an 8 unit condominium development in the Newport Heights area, and the creation of 2 commercial lots in the Old Newport Boulevard Specific Plan. To ensure that an access easement for the condominium development is properly established and maintained, Condition No. 3 of said approval, required a 20 foot access easement, which was modified by the Planning Commission to specify recordation requirements, review of easement documents by the City Attorney's Office, and documentation of recordation prior to the issuance of a building permit. Proposed Final Tract Map and Recommendation Procedures in Section 19.16.150 of the Municipal Code provide that if the City Council determines that a Final Map is in conformity with the Tentative Map and is satisfied with the plan of subdivision, it shall approve the map. The City of Newport Beach Planning and Public Works Departments have reviewed the Final Map of Tract Number 15981 and are satisfied with the plan of the subdivision. In addition, the required Subdivision Agreement and bonds have been submitted and approved by the Public Works Department for the off -site improvements. Staff believes that the Final Map conforms with the approved Tentative Map and therefore, recommends approval of the Final Map, with the finding and condition set forth in the attached Exhibit "A ". That the Final Map of Tract No. 15981 substantially conforms to the Tentative Map of said Tract, with all changes permitted and all requirements imposed as conditions to its acceptance. Condition: That all conditions imposed by the City of Newport Beach Planning Commission in conjunction with its approval of, GPA 91 -2, A 897, V1235, UP 3668, & TIM 15981 shall be fulfilled. Page 5 CITY OF NEWPORT BEACH Page 23 of 30 reorganized after the original subdivision. She said the change meant they fronted on Alvarado Place instead of East Bay Avenue. She said the change intends to impose the same front yard setback as if the lots had stayed organized towards East Bay Avenue. She added that the Planning Commission made the interpretation hat hen a lot has been reorganized that even a ig;nated front yard setback on a side yard would be int ted as a side yard and therefore have a four - foot yard setback. Mayor NoN opened the public hearing. There being n testimony, Mayor Noyes closed the public hearing. Motion by Council MiI ber Ridgeway to introduce Ordinance No. 2000 -4 for Amendment 96 and pass to second reading on February 8, 2000. Council Member Glover stated that she has met with UP 3668 the applicant and feels that the project is a good one. Variance 1235 Mayor Noyes opened the public hearing. Planning Director Temple referred to handwritten page 8 of the staff report and stated that there will be an access easement for the ingress and egress of all four lots between the two existing R -2 lots and the two new residential lots. Council Member Ridgeway confirmed with Planning Director Temple that the owners of the two new residential lots are also the owners of the existing R -2 lots. Planning Director Temple added that the Planning Commission had the same concerns and strengthened the weight of the easement documents used to record the access. Council Member Glover complimented Planning Commissioner Ed Selich for the work he has done. Motion by Council Member Ridgeway to adopt Resolution No. 2000 -13 approving General Plan Amendment No. 91 -2; introduce Ordinance No. 2000 -5 regarding Amendment No. 897 and pass to second reading on February 8, 2000; and sustain the action of the Planning Commission and approve the applications related to the amendments, subject to the Findings, Conditions, as modified by the Planning Commission: Use Permit No. 3668, Variance No. 1235, and Tentative Tract Map No. 15981.
