On October 24, 2000, Council member Glover requested a report on the way the City has
historically negotiated Development Agreements. This report summarizes who was involved in
the negotiations of the City's 11 approved Development Agreements.
The l I development agreements have been approved for a variety of reasons, ranging from
achieving significant public benefits, such as in the CIOSA agreement, to an interest in securing
a long term phasing program, such as for Hoag Hospital. As a result, the primary negotiators
have varied based on the nature of the agreement being drafted. The only consistent party at the
negotiation table is the project proponent. Below is listed the persons or entities involved in
negotiating the primary "deal points" for the City.
Approved Development Agreements:
1. Park Lido: City Attorney and Planning Department staff, for traffic signal improvements.
2. North Ford: City Council, City Attorney, as part of the strategy to resolve housing litigation.
3. Bayview (J.M. Peters): City Manager, City Attorney, to achieve traffic improvement
contributions in association with an annexation.
4. Library Exchange Agreement: City Manager, Board of Library Trustees, to gain a site for the
Central Library.
5. Hoag Memorial Hospital, Presbyterian: City Attorney and Planning Department staff, for
open space dedications, improvement contributions, and a phased development program.
6. Circulation Improvement and Open Space Agreement ( CIOSA): City Council Ad Hoc
Committee, City Manager, for open space dedications and circulation system improvement
funding.
7. Pacific View Memorial Park: City Council, Planning Department staff, for construction
phasing, landscaping, and design requirements.
S. Ford Motor Land Development (One Ford Road): City Manager, City Attorney and Planning
Department staff, for park dedication and affordable housing in -lieu fees.
9. Fletcher Jones Motorcars: City Council, City Manager, for site conveyance and
improvements to retain the business in the City.
10. Newport Harbor Lutheran Church: City Attorney and Public Works and Planning
Department staff, for a land exchange.
11. Bonita Canyon: City Council, City Manager and Planning staff, for annexation to the City. •
12. Newport Coast/Newport Ridge: City Council, City Manager and City Attorney; for
preservation of entitlement and continuation of County subdivision and project approval in
association with annexation.
Pending Development Agreements:
Newport Dunes: Council PORT Committee, City Manager, City Attorney, Assistant City
Manager and Deputy City Manager, to ensure quality project, secure TOT, and contributions
to water quality and park improvements.
Conexant: Committee of City Council members and Planning Commissioners, City Manager,
City Attorney, Assistant City Manager, Planning and Public Works Department staff, for
contributions to long -range planning and transportation improvements in the airport area
Koll Office: Committee of City Council members and Planning Commissioners, City
Manager, City Attorney, Assistant City Manager, Planning and Public Works Department
staff, for contributions to long -range planning and transportation improvements in the airport
area.
