March 13,2001 Agenda Item No. 17 CITY OF NEWPORT BEACH CITY MANAGERS OFFICE March 13, 2001 TO: Mayor & Members of the City Council FROM: Homer Bludau RE: Proposed Arts & Education Center INTRODUCTION Since 1998, representatives of the Board of Library Trustees, Arts Commission and the Newport Beach Arts Foundation have discussed the possibility of constructing an Arts and Education Center (Center) on approximately 3.5 acres of land just north of the Central Library (Newport Village). The proposed 22,000 square foot Center would accommodate a 400 seat auditorium, a 6,000 square foot "hall ", a public gallery, and arts education classrooms. The Center would be served by a 460 space parking structure with a landscaped "roof that would provide approximately 200 spaces for library staff and customers. A pedestrian bridge would provide access from the parking structure to the Central Library. Center construction would be funded through private donations solicited by the Newport Beach Arts Foundation. On June 27, 2000 the City Council appointed an ad hoc committee to address issues related to the Center. The ad hoc committee consists of two Council Members, and one member each from the Board of Library Trustees, Arts Commission and Parks Beaches and Recreation Commission. The ad hoc committee was directed to meet with community members to determine their position on the Center, to determine if the Center would preclude other uses of the Newport Village site and to determine what planning approvals would be necessary to implement the proposal. The ad hoc committee was requested to report their findings after completing these tasks. The committee has not yet reported to the Council. Although staff has not thoroughly researched the planning approvals needed, we believe that amendments to the General Plan and Planned Community regulations, as well as environmental review, will be required. On February 27, the City Council considered whether to accept a donation for a feasibility study to determine "community support" for the Center and a "central park" on the Newport Village site. Council Member Bromberg proposed to continue the item to March 27' to allow the Council and staff time to develop parameters for the feasibility study. However, in response to public testimony Council Member Bromberg modified his motion to "table" consideration of the feasibility study and to determine, at the March 13' meeting, if the Council wanted to continue pursuing the concept of the Center on the Newport Village site. The City Council has many options including the following: 1. Not to pursue further consideration of the Center on the Newport Village site at this time and terminate the ad hoc committee 2. "Yes!" to all of this property being landscaped as a natural park with meandering paths & native plants. The silhouette of greenery on a background of sky is restful to eye and mind. Thus open space has value to citizens and to critters like birds & bugs. "Yes!" to an arts center in another space that is already developed and can be enhanced by redevelopment as a city arts center. The OC Museum of Art has publicly stated that they wish to move to Costa Mesa to a site near the performing arts center. If that museum leaves Newport two existing buildings will remain that can become an arts center. A parking structure will be needed since the parking lot has been developed. "No" to any building on land dedicated to open space. There is currently insufficient natural habitat remaining in Newport. That open space with its views should be left open, as it is irreplaceable. A "cultural center" or arts education facility can be located anywhere, and Orange Coast College may be the best alternative. 2. The need for a 400 -seat auditorium in that location, I believe, is not demonstrated. There are, no doubt, several alternatives in the Newport Center area that could be used for those occasions when expanded seating is needed. Ask the Irvine Company to provide space. I think it is a good idea to resist the idea that every remaining open space must be "paved over." It doesn't have to be, nor should it be. The citizens of Newport Beach deserve to see this unique and beautiful parcel of land be designated an open view park. With regard to Mr. Gregory's questionnaire, it is very difficult to draft a survey that is truly neutral with no inserted bias toward a particular point of view. If the arts center proponents are drafting the questionnaire, it is not likely to be completely balanced, and shouldn't be relied upon. This property is presently zoned as open space and I would expect that not to be changed. As you know, it is a welcoming sight as one drives into our city and it could and should become as well recognized as the Pavilion that identifies our Bay. There is precious little open space left in our community and this could be our "Central Park" as I heard one group identify it. I oppose ANYTHING that will attract more traffic to these already over burdened streets (San Miguel, Avacado, and MacArthur). Is there any space possible near the art museum that could be utilized? I find this hard to believe mainly because the success of NTAC has been the result of the tremendous work and effort of a dedicated group of people, who have given freely of their time and financial resources to create one of the top theater arts groups in the country. It is their efforts, not the site, which have created this success and for a "Johnny come lately" to come forward and demand their right to this showplace merely because it is public land, is in my opinion greatly unfair. Please vote against it. 1) This land has been designated as open space and should remain so. It should not be possible for every "new" City Council to change their minds about this land. 2) This project has come to be because one person in the City advises the Arts Commission, Parks and Recreation and the Library. This one person has been very instrumental in pushing this project. Please, please divide the responsibility and once again give Newport Beach a full time librarian. 3) The Library Board of Trustees' job is to run the library. It should not be taking a stand on an auditorium building. Yes, the library needs more parking but that does not entail an arts building. 4) On Tuesday at the meeting of the Ad Hoc Committee for Arts and Education Center, Don Gregory stated that the group had already raised $4.5 million toward this building. Under what authority is the Arts Foundation out raising money in the name of Newport Beach? The Library Foundation has guidelines set down by the City Council and was sanctioned by the City Council before they raised a dime. 5) Any effort for this group to raise money for a building "affiliated" with the library is going to be extremely detrimental to the efforts of the Library Foundation to raise money for the library. People who have and will support the library do not want their money going toward an auditorium. 6) Orange County Art Museum has classrooms and runs many art classes for children and adults. The Balboa Theater group has been actively raising money to restore that facility which will satisfy the need for an auditorium. To date, they still need about $4 million. If the City wants an auditorium, it would seem to me that city money could be donated to finish that project before we undertake yet another fund raising project.. 7) It is one thing to build this building, it is another to maintain it. When we were in the process of building the library we always knew that it was Newport Beach Public Library. A few years back, someone wanted to donate cherry trees for the area back of the library and that request was turned down because they would have to be watered. Now they are talking about a building which uses lots more money than just water. Please vote against this project to be built adjacent to the library. Thank you. Unfortunately, it's pretty much a one -way street. Once open space is covered over, it remains covered, and we aren't able to create more of it. There is always an excellent justification for removing the open space designation, and this is true for the property behind the library. Senior housing, once proposed, a cultural center - -one would have to be an antisocial philistine not to see merit in such projects - -but both are things that could be placed anywhere. What a marvelous park this land would make - -a beautiful view of what makes Newport notable - -the water. We've covered up that view in so many places. The very notion that it is a civic function for such an oblication is preposterous. Exceedingly oversold, the idea for art - perpetuation as a duty for the taxpayers is completely unrealistic. fiany, if not most of the municipalities in this country do not finance these types of non - essential activities. Fine Arts Center such as Santa Fe, Carmel and Lacuna Eeach do quite well without one. A .12 million dollar structure to support the art passions of a few is surely an unconscionable waste of money, especially when you consider that this city has adequate facilities in litraries, senior centers, the district schools, and private work centers. As a 3E year home owner in Corona del filar and an active purveyor of the visual arts, I can support the use of classrooms, 1-octy centers, �lewport Beach's two 7.enior Centers, and 2 year coilece campus's where the fine arts are instructed. I have had hours of art instruction in such facilities, as well as teaching art Classes in these local places. We do not need another "Bureau" for new taxes and for expanded city payroll. Nor do we need to waste our valuable property for such a limited demand for this -non -civic type of free time activity. I strongly urge you to vote 11\10 on the new type of "Empire 3uildi7ic" that we can do well without. Personal calls were also made to Claudia Owen, SPON, to make a presentation on their concept for an open space passive park; and Roberta Jorgensen, Arts Commission, on an Arts 8 Education Center. I am particularly conversant with the issues relating to this open space because as President of the Central Newport Beach Community Association in 1976, 1 filed an appeal (with the assistance of Dorothy Beek, Secretary of the Central Newport Beach Communitv Association), with The California Coastal Commission against the City of Newport Beach Gty Council's decision to approve the greater expansion of Fashion Island at that time. At the time of the California Coastal Commission Hearing in San Francisco, which I attended on behalf of CNBCA, I was the only person present representing opposition to the Irvine Company plan. I introduced the suggestion that an area of open space be reserved as a condition for approval of the project. I also wanted to ensure there would be space for a transportation center, subsequently built but not included in the Imine Company's original plan. The land now under consideration, under the jurisdiction of The California Coastal Commission, was dedicated in perpetuity as "Open Space." At present, l am on vacation in Europe, but on my return t would be happy to supply any further information that will prove to you the original intent of the open space property now under consideration at Fashion island. Our area is soon -to -be Newport Beach, believe, and before we moved here we lived in Eastbluff for 12 years. In my view, open space worth protecting against all intrusions is what Harbor Cove and Castaways used to be, and what the site at Jamboree and PCH is now. It is wide, undeveloped swaths of open land with beautiful vistas or wetlands to protect. The areas surrounding the Back Bay are perfect examples of what we should protect against development at all costs (we did vote in favor of the bond issue which failed). A passive park at Jamboree and PCH would be a great land use instead of more housing. The space along MacArthur near the library is more of a week -eaten eyesore of a narrow strip looking out onto MacArthur and Avocado and in the midst of lots of traffic and business. It would be a perfect place for an arts and education center /passive park combination. It could be joined by pathways to the library and be absolutely lovely. It does not have to be high density or block views (which is what this is truly about for a small group of Harbor View homeowners). This would be a great place to meet and relax, a central park area for our city. It would also serve the needs of the arts and education center. What is the big deal here? I'm sure the same people who oppose this project also opposed the library and the new shopping center (the latter of which we probably could have lived without). The library has turned out to be an incredible assset to our community, which would only be enhanced by putting a park and arts center next door. This is the most logical site in our city for such a center. Please look at the addresses of the vocal opponents to this use. I bet most of them have selfish (view) interests at heart. Those are always the most vocal people, but this does not necessarily reflect the overall wishes of the citizens of the community. The problem with the current proposal is not WHAT it is, but WHERE it is. We have addressed the use of this site time and time again. It was dedicated to remain open park land by the Irvine Company in exchange for their developing another site. That was supposed to be in perpetuity. Then someone tried to take this park for senior housing, until that plan was finally moved elsewhere. Now we're back here again over an arts and cultural center on what we thought was a done -deal park. How many times do we have to rehash the useage of this site? What is there about perpetuity that we don't understand? our City, and particularly the Fashion Island area, has a known parkland deficit. The State has declared us lacking in open space park acreage. This particular park site supports coastal sage scrub plant, bird, insect, and mammal wildlife right now. Dear Ladies and Gentlemen: As principal of Corona del Mar High School, "it has been a dream of mine, shared by many parents and staff members, to have a Performing Arts Theatre in our community. Our vision has been to establish a joint -use facility with the city of Newport Beach. The possibility of a facility in the Newport Center is very appealing. One of the other possibilities would be to locate the facility on the campus at Corona del Mar High School. Initially, this was a goal of the CDM Foundation. Obviously, this proposal would be very convenient for the students of CdM. However, in reviewing the feasibility of utilizing the campus, there are several major concerns. First, the enrollment of the school is increasing by over 100 students per year and we are projected to continue this growth for the next several years. We now are utilizing all of our classroom space, including the two portable classroom buildings, which were originally going to be moved to make space for the Performing Arts Theatre. If we are going to establish a joint -use facility, parking and traffic flow will be a tremendous problem. A traffic impact analysis would have to be undertaken. Also, the Easibluff Homeowners Association will definitely have an opinion on any facility which would bring more traffic and congestion into the residential community surrounding the high school. Finally, the opportunity to raise funds for the facility may be curtailed, by locating it on the high school campus. Some of the donors may rescind their pledges, if the location is not centrally located in the Newport Center. My personal feeling is that for the enrichment of the community of Corona del Mar and the east side of the bay, the facility would best be located in the Newport Center. This location can be made into a beautiful cultural center for the community, while serving the needs of the local schools. If it is carefully designed with the upper portion of land being used as a park, as has been recommended by at least one civic group, it will become a landmark of the community instead of the eyesore it is currently.
