HomeMy WebLinkAbout08 - Dedication of a Portion of Edgewater PlaceJune 26, 2001 CITY COUNCIL AGENDA ITEM NO. 8 TO: Mayor and Members of the City Council FROM: Public Works Department SUBJECT: ACCEPTANCE OF OFFER TO DEDICATE A PORTION OF EDGEWATER PLACE AS REQUIRED BY THE CALIFORNIA COASTAL COMMISSION LOCATION: The northerly 35 -foot wide section Lots 1, 2, and 3 of Block 3 of the Balboa Bayside Tract recorded in Book 4, Page 78 of Miscellaneous Maps and Records of Orange County, also known as Edgewater Place. RECOMMENDATIONS: 1. Accept an Offer of Dedication of the northerly 35 feet of Lot 23 of the Bayside Tract and the northerly 35 feet of Lots 1, 2, and 3 of Block 3 of the Balboa Bayside Tract for pedestrian access and passive recreational use. 2. Adopt the Resolution accepting the dedication of the northerly 35 feet of Lot 23 of Bayside Tract and the northerly 35 feet of Lots 1, 2, and 3 of Block 3 of the Balboa Bayside Tract. 3. Direct the City Clerk to have the documents recorded in the Office of the Orange County Recorder. DISCUSSION: In 1985 the Coastal Commission required the owners of the subject parcels to give an irrevocable Offer of Dedication for a 35 -foot wide public access easement along Edgewater Place as a part of approving Coastal Permit No. 5 -85 -445. This Offer of Dedication was required by the Coastal Commission in order to provide maximum public access to the shoreline (see Exhibit A). The City has the authority to accept the dedication as offered in order to maintain the public access and passive recreational use along the Edgewater Place promenade. The City did not previously accept the Edgewater Place Offer of Dedication because for several years we were not aware of its existence, as it was a Coastal Commission requirement. Once the City became aware of the Offer of Dedication, there was no urgency to accept the offer as the public has used Edgewater Place for years through prescriptive rights.
