MEMORANDUM
TO: Members of the City Council

SUBJECT: MODIFICATIONS TO CITY CLERKS EMPLOYMENT AGREEMENT
(C -3080)
RECOMMENDATION
1) Adopt Resolution No. 2001 -_ adjusting the terms and conditions of the
Employment Agreement with the City Clerk;
2) Direct staff to prepare an amended Employment Agreement to include the
• proposed work schedule change, as well as previously approved changes, in
order to accurately reflect the terms and conditions of Harkless' employment as
City Clerk; and
3) Authorize the Mayor to execute the updated Employment Agreement with the
City Clerk.
BACKGROUND
City Clerk Harkless signed an Employment Agreement with the City on January 15,
1996. The Agreement calls for performance evaluations on at least an annual basis.
On June 26, 2001, the City Clerk was evaluated and received a satisfactory
performance evaluation from the City Council based on her job performance. Given
the successful performance evaluation, the City Council is recommending that her
Employment Agreement be modified to give her the right to work a 9/80 schedule.
The City Council has recently granted pay increases to the City Manager and the City
Attorney,
At the tinne of Mrs. Harkless' evaluation she was also instructed to survey other cities
to detern- ne if her compensation is comparable to other cities. The results of that
informal survey will be presented to City Council at a later date for Council
consideration.

RESOLUTION NO. 2001-
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, ADJUSTING THE TERMS
AND CONDITIONS OF THE CITY CLERK'S EMPLOYMENT
AGREEMENT
WHEREAS, pursuant to the City Clerk's Employment Agreement which
establishes performance evaluations at least on an annual basis, the City Council conducted an
annual evaluation on June 26, 2001; and
WHEREAS, an adjustment to the terms and conditions of the current employment
agreement are appropriate given the manner in which the City Clerk has performed the various
duties of the position.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Newport Beach authorizes an amendment to the employment agreement between the City and
the City Clerk to give the City Clerk the right to work a 9/80 work schedule effective with the
• second pay period in July, 2001.
