Conditionally approve the request of Newport Harbor Area Chamber of Commerce for the installation of 205 banners, from August 15, 2001 to September 18, 2001. Installation shall be along Jamboree Road, MacArthur Boulevard, Westcliff Drive, Newport Boulevard, and Newport Center Drive East/West. No 2. Deny the request. DISCUSSION: Newport Harbor Area Chamber of Commerce ( NHACC) has requested that 205 private banners be installed from August 15, 2001, through September 18, 2001, in the Fashion Island area for the 13th Annual 'Taste of Newport". The banners will be mounted on street light poles along Jamboree Road (35 banners), Newport Center Drive East/West (126 banners), Westcliff Drive (9 banners), Newport Boulevard (2 banners), and MacArthur Boulevard (34 banners) public right -of -way, per attached exhibit. Twenty of the banners on Newport Boulevard are in the Caltrans right -of -way and Staff will prepare the required Encroachment Permit application . On the weekend of September 14 -16, 2001, NHACC will host the 11th Annual "Taste of Newport" — a dining and entertainment celebration highlighting the many restaurants in Newport Beach. The Chamber reports that over 65,000 people attend the 'Taste of Newport" events. Attendees will pay a $15 admission charge to enter the event and will, if interested, purchase scrip to receive food and drink from participating restaurants and caterers. For eleven consecutive years the Costa Mesa based 'Times Orange County" is the co- sponsor and underwriter of 'Taste of Newport". To recognize the newspaper's role, the Chamber has designed a 2 -foot by 7 -foot banner that includes the 'Times" logo on the top of the banner. SUBJECT: Approval of "Taste Of Newport" Banners August 14, 2001 Page 2 On Wednesday, July 30, 2001, NHACC president Richard Luehrs asked the City to allow the Chamber to install the banners on City light poles between the period of August 15, 2001, and ending on September 18, 2001. The event is not co- sponsored by the City of Newport Beach, not organized by a non- profit organization, not free to the public, and does not exclude advertisement of the sponsor (Times) as required per City Council Policy L -16. Council Policy L -16 prohibits the use of a commercial sponsor's name on the banner. However, the event will be community -wide, open to the public, and may create additional revenue to the City through restaurants, businesses, and hotel reservations. The applicant's request to install 205 private banners will exceed the 100 - banner limit and the single banner per pole concept allowed per City Council Policy L -16. In the past, the following similar requests have been approved by City Council: "Taste of Newport" (approved August 23, 1999) and Orange County Museum of Art (approved October 12, 1998). There have been no reported public complaints regarding the banners in the past. Should the City Council elect to approve the installation of 205 private banners in the Fashion Island area for 35 days, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles. 2. On Newport Center Drive (from East Coast Highway) and Newport Center Drive East/West (Ring Road) the locations shall be limited to the center median. Two banners will be installed per each pole. 3. The applicant must provide on -going maintenance of the banners and brackets. 4. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 5. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a financial size category of "VIII" or higher. 6. Issuance of an Encroachment Permit by the Public Works Department. 7. The banners shall conform to City Council Policy L -16 with the exception of the number of banners, advertisement of sponsor, open to the public free of charge, and co- sponsor by the City. 8. All banners and brackets shall be removed by the end of the approved time unless otherwise approved by the conditions stated in the Encroachment Permit. SUBJECT: Approval of -Taste Of Newport" Banners August 14, 2001 Page 3 9. All banners and brackets shall comply with the Encroachment Permit conditions. 10. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. 11. A minimum of two 5- inches wide half - circle wind slits per banner are required to minimize the wind load. 12.
