ACTION: Initiate the amendment to the General Plan, Land Use Element as recommended by the Planning Commission by approving GI 2001 -001. GENERAL PLAN: Administrative, Professional Financial Commercial ZONING DISTRICT: Newport Place Planned Community Planning Commission Action On August 23, 2001, the Planning Commission considered the subject amendment and voted to recommend approval of the initiation request. Background The City Council recently amended policy K -1 to permit the initiation of a general plan amendment at any time. Additionally, an individual initiation expires within 180 days of its approval. The revised council policy related to initiation procedures is attached as Exhibit No. 1. Proposed Amendment Camco Pacific Construction has submitted a request to amend the general plan for Block G & H of the Airport Area within the Newport Place Planned Community (Exhibit No. 2). The existing office building located at 1811 Quail Street has been leased and the new tenant needs an additional 1,500 square feet of office space. Blocks G & H of the Newport Place Planned Community are presently overbuilt based upon present information. Therefore, the requested 1,500 square foot addition requires an amendment to the General Plan as well as an amendment to the Newport place Planned Community text to increase the development allocation. No other change to the General Plan or Newport Place Planned Community is requested. The proposed addition will be on the second floor of the existing office building and the building footprint will not be expanding. From the preliminary site plan supplied by the applicant, it appears that the site will provide sufficient parking. The project also should qualify for a Categorical Exemption from the California Environmental Quality Act. Planning Department Workload The Department continues to experience a high workload, and is operating beyond capacity in some areas. Because of the high on -going workload, the Department has retained contract staff for some development requests currently in process. The Department has recently filled a vacant Associate Planner position with a new employee who will be starting on September 10th. In the coming months, we anticipate that the workload will ease and application processing times will improve. With the new hire, the Planning Department will be at full staff with no vacancies. Amendment to the General Plan shall be initiated by the City Council after recommendation from the Planning Commission. B. In initiating action to amend the General Plan, the City Council shall direct the Planning Commission to set public hearings for such amendments, as it deems appropriate. C. Prior to making its recommendation on the initiation of proposed General Plan amendments, the Planning Commission may do such research, as it deems necessary to establish whether the proposed amendment warrants consideration. D. A citizen and /or property owner may request an amendment to the General Plan. Such request shall be submitted in writing to the Planning Commission. The request should clearly set forth the reason for which the request is made, and should contain information substantiating the need. When an amendment is requested for a specific parcel or parcels in the City, the request must be made by the property owner or his or her authorized representative or by the Planning Commission or City Council. A project specific amendment request shall include a quantification of the requested density and /or intensity, land use, and a conceptual site plan. The Planning Commission and City Council may also propose amendments to the General Plan. If the Planning Commission, after examination, is convinced that the proposed change is worthy of initiation, it may recommend initiation of amendments as set forth above. If not, the Commission shall forward the request to the City set forth above. If not, the Commission shall forward the request to the City Council with its recommendation that initiation of the amendment is unwarranted. The City Council, after consideration of the request and of the report from the Planning Commission, may either initiate the proposed amendment and direct the Planning Commission to set for public hearing, return the request to the originator without further action, or defer action on the proposed amendment to future hearing sessions based on Planning Department work loads and project priorities. E. Amendments to each General Plan element may be initiated at any time. A number shall be assigned in sequence to each amendment or group of amendments at the time it is initiated by the City Council. F. If a citizen and /or property owner amendment request is initiated, all applications related to the request must be filed within 180 days of the initiation. If applications are not filed within this time - frame, the initiation shall expire. Ms. Temple noted that this is the first time item to be heard on the revised City Council Policy regarding amendments to the General Plan where the City will now allow these amendments of any time rather than the previous three times a year limit. As noted in the staff report, there is a requirement that the related applications be filed within a six -month timeframe of initiation. ���� Commissioner Agajanian asked the advisability of postponing this matter until after the General Plan update; how long would it take for the amendment to go through the process? Ms. Temple answered that is certainly within the purview of the Planning Commission's recommendation to the City Council, however, in this particular case the requested amendment is extremely small (1,500 square feet) and is in relationship to a specific project of the applicant. I do not believe that action on the initiation one way or another would materially affect the City's ongoing study of the General Plan update. An application of this nature is in a similar timeframe to any simple zoning application. They would normally be completed in a three or four month period. This application will also require an amendment to the Newport Place Planned Community to add the square footage of entitlement in the zoning text. Vice Chairman Kiser referred to the letter submitted as part of the application from Cameo Pacific. It discussed square footage of existing space in the area as of January 1987, and planned projections. It also indicates that a number of 342,641 square feet existed in that area, which is about 47,000 square feet more than what were planned projections back in 1987. Could you explain if the amount of space built in an area often go way over what is projected by the City in prior years? Ms. Temple answered that in the 1987 General Plan, all the numbers within the plan were based on a research of building records. It was our best effort to make those calculations as accurate as they could have been. We know that from time to time when we research and re- analyze these areas that there was already more development on the ground than we had found in that initial data gathering exercise. We did disclose this to the Planning Commission and the City Council back in 1988 when these numbers were adopted. Basically we got there concurrence that when errors of the data were discovered that it was 2 City of Newport Beach Planning Commission Minutes August 23, 2001 INDEX not the intent of the City to make any standing development non - conforming by virtue of adopting the more precise numbers in the General Plan. We believe it was the intention of the City Council to establish numbers that were consistent with the standing development. In this case, we will correct the numbers in the Plan to reflect the standing entitlement as well as the requested addition. This area is totally built out as for as standing entitlement goes. Steve Labrin, Cameo Pacific Construction stated that they are purchasing this building and hope to expand the space to accommodate the existing staff. Because of the Greenlight issue in the area, they understand that they need to go through this process to add this square footage on to the project. They are requesting to do so. Public comment was opened. Public comment was closed. Motion was made by Commissioner Kranzley to recommend that the City Council approve General Plan Initiation No. 2001 -001. Ayes: McDaniel, Kiser, Agajanian, Gifford, Kranzley Noes: None Absent: Tucker, Selich SUBJECT: 4341 MacArthur Boulevard, Suite f La Salsa; Milestone Management • Use Permit No. 2001 -018 (PA2001 -086) Use Permit to expand the seating of an existing specialty food establishment (SF# 50) from 21 seats to 36 seats with no increase in net public area. The increased seating changes the use classification from specialty food to full service, high turnover. This classification change increases the required parking between 7 to 17 parking spaces depending upon what parking ratio is used. No alcoholic beverages are presently served and no ABC license is sought. Ms. Temple noted that the applicant has requested that this item be continued to the next meeting of September 20, 2001. Motion was made by Commissioner Kranzley to continue this item to September 20th. Campbell Senior Planner City of Newport Beach 3300 Newport Blvd. Newport Beach, CA 92658 -8915 Re: General Plan Amendment Initiation 1811 Quail Street, Newport Beach CA Dear Jim: We are proposing an amendment to the City of Newport Beach's General Plan for the above referenced address. The following is a general description of the property in its current state and the proposed alterations planned under this amendment. The properties address is 1811 Quail Street, located in area 3A, block G & H, of Newport Beach. It is currently a two -story structure totaling 9,210 gross square feet. The area is currently zoned for commercial space. We are proposing an addition of 1,590 gross square feet with all but 90 SF to be located on the second floor. This addition would increase our total gross square footage to 10,800. This addition would be at the west end of the building (away from the street), as shown on the attached site plan. The parking would increase to 48 spaces, as required by code, as also laid out on the attached site plan. The exterior skin of the building is planned to be refinished with a similar system to the existing stucco with additional architectural features and entry. Within Area 3A, block G & H the current recorded gross square footage as of 111187 was 225,001 square feet. The planned projections were 295,952 for a projected growth of 40,951 square feet. On June 15, 2001, during our due diligence period to purchase the property, we pulled and reviewed all the building permits within the G & H block. The total square footage tabulated for this area was 342,641 square feet. Due to our findings, we ask you to accept this letter and its attachments as initiation to the application process to amend the General Plan. Your kind review is greatly appreciated.
