They were appointed by the City Council by majority vote for 4- year terms. At the table in front are City staff members who are here to advise the Commission during the meeting. They are: SHARON WOOD, Assistant City Manager PATRICIA TEMPLE, Planning Director JAMES CAMPBELL, Senior Planner TODD WEBER, Associate Planner GINGER VARIN, Planning Commission Secretary RICH EDMONSTON, Transportation & Development Services Manager ROBIN CLAUSON, Assistant City Attorney NOTICE TO THE PUBLIC Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth Tuesdays of each month at 6:30 p.m. Staff reports or other written documentation have been prepared for each item of business listed on the agenda. If you have any questions or require copies of any of the staff reports or other documentation please contact the Planning Department staff at (949) 644 -3200. APPEAL PERIOD: Use Permit, Variance, Site Plan Review, Resubdivision, and Modification applications do not become effective until 14 days after the date of approval, during which time an appeal may be filed with the City Council. General Plan and Zoning Amendments are automatically forwarded to the City Council for final action. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. NEWPORT BEACH PLANNING COMMISSION AGENDA May 23, 2002 CALL TO ORDER 6:30 p.m. PLEDGE OF ALLEGIANCE ROLL CALL May 9, 2002 PUBLIC COMMENTS: Public comments are invited on non - agenda items generally considered to be within the subject matter jurisdiction of the Planning Commission — Speakers must limit comments to 3- minutes. Before speaking, please state your name and address for the record. REQUEST FOR CONTINUANCES: HEARING ITEMS: ITEM NO. 1. SUBJECT: Brumbaugh Residence 201 Apolena Avenue SUMMARY: Request to construct a new single - family dwelling, portions of which would encorach within the required side, front and rear yard setbacks. A front entry, kitchen and second floor balcony are proposed to encroach between 2 and 4 -foot, 6- inches within the 10 -foot setback adjacent to Apolena Avenue. A two -car garage and a portion of the first and second floor living areas are proposed to encroach 15 feet within the required 20 -foot front yard setback adjacent to Park Avenue. A 7 -foot encroachment for the building is proposed within the required rear yard setback along the northerly property line. ACTION: Uphold, reverse or modify the decision of the Modifications Committee approving Modification Permit No. 2002 -032 (PA2002 -001) ITEM NO. 2. SUBJECT: Cingular Wireless 1601 Marguerite Avenue SUMMARY: Request to exceed the 32 -foot height limit in order to construct a church tower for the purpose of housing cellular telephone antennas proposed at an existing church in Corona del Mar. The proposed new tower will be approximately 37 feet in height. Zoning Code Section 20.65 permits structures to be up to 50 feet in height upon approval of a Use Permit. ACTION: Remove Use Permit No. 2002 -007 (PA2002 -047) from calendar. ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS TAPE RECORDED. SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. (Red light signifies when three minutes are up; yellow light signifies that the speaker has one minute left for summation.) 0 ITEM NO. 3. SUBJECT: EZ Lube 3600 East Coast Highway SUMMARY: Request for a Use Permit to allow construction of an automobile lubrication facility consisting of a 2,641 square -foot building with two service bays located in Corona del Mar. The application includes a request to waive three of the ten space off - street parking requirement. ACTION: Approve, modify or deny Use Permit No. 2002 -005 for Property Located at 3600 East Coast Highway.
