Webb, Public Works Director- (949) 644 -3330, dawebb @newportbeachca.gov PREPARED BY: Andy Tran, Senior Civil Engineer PHONE: (949) 644 -3315 TITLE: Adopt a Resolution Authorizing the Submission of Two Grant Applications to the Orange County Transportation Authority (OCTA) as part of their Arterial Pavement Management Program - Call for Projects (CAP15 -0006 and CAP15 -0007) ABSTRACT: Staff recently submitted two grant applications to OCTA in an effort to obtain federal grant funding for the up- coming MacArthur Boulevard Pavement Rehabilitation Project. The application process requires the City Council to adopt a resolution authorizing the submission of these applications for grant funding. RECOMMENDATION: Adopt Resolution No. 2015 -3, A Resolution of the City Council of the City of Newport Beach Authorizing Application for Funds for the Arterial Pavement Management Program Funded with Regional Surface Transportation Program Funding Under the Moving Ahead for Progress in the 211t Century Federal Transportation Act for the MacArthur Boulevard Rehabilitation from East Coast Highway to Bonita Canyon Drive Project. FUNDING REQUIREMENTS: The two grant applications were submitted requesting a total of $1,000,000 from the current OCTA Arterial Pavement Management program; $500,000 for each of the two phases of the planned MacArthur Boulevard Pavement Rehabilitation project. Should the City be successful with these grant applications, the City's required local match will be 50 percent of the total project construction cost, or $1,000,000. Matching funds are currently /and will be included in the City's Capital Improvement Program (CIP) Budget for this project. M DISCUSSION: OCTA recently conducted a Call for Projects as part of their Arterial Pavement Management program. Available federal grant funds from this program are from the Regional Surface Transportation Program. As part of this Call for Projects, approximately $20 million will be available for pavement maintenance and reconstruction purposes to the 35 local agencies in Orange County which includes 34 cities and the unincorporated areas of Orange County. Each agency is allowed to submit up to two applications. The maximum amount of grant funds for each application is $500,000 with a minimum local match rate of 50 percent. On September 25, 2014, staff submitted two applications for the pavement rehabilitation of MacArthur Boulevard. The first application is for MacArthur Boulevard from East Coast Highway to 1,000 feet north of San Joaquin Hills Road (Phase 1). The second application is for MacArthur Boulevard from 1,000 feet north of San Joaquin Hills Road to Bonita Canyon Drive (Phase 2). These limits of work were strategically selected in order to maximize grant funding reimbursement. Staff was required to submit a draft Council Resolution to OCTA as part of the application process authorizing the submission of the two grant applications. A final resolution is now required in order to continue to participate in this application and selection process for projects. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been publicly noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). WHEREAS, the United States Congress enacted the Moving Ahead for Progress in the 21St Century (MAP -21) Federal Transportation Act on July 6, 2012, which makes the Regional Surface Transportation Program (RSTP) funds available to the Orange County Transportation Authority (OCTA); and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS, the City of Newport Beach possesses authority to nominate projects funded using RSTP funding, provide sufficient local match, and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action, the City Council of the City of Newport Beach authorizes the nomination of the proposed project, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Newport Beach to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Newport Beach will maintain and operate the property rehabilitated for the life of the resultant facility; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and /or OCTA, the City of Newport Beach or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Newport Beach will give Caltrans and /or OCTA's Cam! representatives access to and the right to examine all records, books, papers or documents related to the arterial pavement management project; and WHEREAS, the City of Newport Beach will cause project work to commence within six months following notification from the State or OCTA that funds have been authorized to proceed by the Federal Highway Administration and that the project will be carried to completion with reasonable diligence; and WHEREAS, the City of Newport Beach commits $1,000,000 of General Fund, Gas Tax and /or M2 Fair Share funds, which equals 50% of the total project cost as match to the requested $1,000,000 in OCTA RSTP funds for a total project cost estimated to be $2,000,000; and WHEREAS, the City of Newport Beach is responsible for preparing and submitting all necessary Caltrans required documentation including an E -76 request. The City of Newport Beach agrees to submit an E -76 Request to Caltrans District 12 by February 1 of the fiscal year identified; and WHEREAS, the City of Newport Beach will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, Federal Title VI, Disadvantaged Business Enterprise (DBE), Buy America provision, and any other federal, state, and /or local laws, rules; and WHEREAS, the City of Newport Beach's City Council authorizes the execution of any necessary cooperative agreements between the City of Newport Beach and OCTA to facilitate the delivery of the project; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Newport Beach authorizes Public Works Director, David A. Webb, as the official representative of the City of Newport Beach to apply for the RSTP funding under the MAP -21 Federal Transportation Act for OCTA's Arterial Pavement Management program. M BE IT FURTHER RESOLVED, the City of Newport Beach agrees to fund its share of the project costs and any additional costs over the identified programmed amount. HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted at a Regular Meeting of the City Council of the City of Newport Beach on this 131h day of January, 2015. City Clerk
