Bludau, City Manager DATE: September 24, 2002 SUBJECT: Report to the City Council Regarding LAFCO Actions on City's Annexation Application of East Santa Ana Heights, Bay Knolls and the Emerson Tract and on LAFCO Actions Regarding West Santa Ana Heights ISSUE: Status report on LAFCO annexation actions. RECOMMENDATION: The City Manager be directed to undertake an analysis of service requirements for West Santa Ana Heights and a revenue /cost analysis of such an annexation. Council discussion as needed. BACKGROUND: In 2001, the City of Newport Beach submitted a comprehensive annexation application to the Local Agency Formation Commission ( LAFCO) for consideration. LAFCO is the agency created by the State with annexation approval and denial authority. The City's application included the Newport Coast, East Santa Ana Heights and Bay Knolls areas. The purpose of this annexation application was to complete the annexation of the City's Sphere of Influence as determined by LAFCO in 1974. The "Sphere of Influence" is a term meaning County areas which most logically can best be provided services by an identified adjacent city. When LAFCO first considered the City's comprehensive application, it bifurcated the Newport Coast area from the other areas and considered it separately. LAFCO held up taking action on the City's East Santa Ana Heights and Bay Knolls application until it received the annexation application from Costa Mesa, which was intending to annex its Sphere of Influence County islands located between Costa Mesa and Newport Beach. That application was received, and LAFCO met on September 16 to conduct public hearings on the annexation applications of both cities. After the public hearing, LAFCO took the following actions: 1. East Santa Ana Heights — annexation application approved by 7 -0 vote; set 45 -day protest period starting October 17th; if insufficient protests are received, annexation becomes effective July 1, 2003. 2. Bay Knolls — Bay Knolls Sphere of Influence detached. from Costa Mesa; Sphere of Influence attached to Newport Beach; annexation to Newport Beach approved by 7 -0 vote; 45 -day protest period starts October 17th; if insufficient protests are received, annexation is effective July 1, 2003. 3. Emerson Tract (9 homes — 1.9 acres) — Sphere of Influence detached from Costa Mesa to Newport Beach; LAFCO continued the annexation for 6 months to allow Newport Beach to complete pre- zoning of area. 4. West Santa Ana Heights — LAFCO continued the proposed West Santa Ana Heights Sphere of Influence amendment for 6 months, pending a pre- zoning decision by Newport Beach. 5. Santa Ana Country Club and Mesa Drive Area — LAFCO approved annexation to Costa Mesa. If these two areas obtain enough protests to defeat annexation to Costa Mesa, LAFCO will consider asking Newport Beach to consider annexation. Since LAFCO has requested that Newport Beach take 6 months to consider its interest in the annexation of West Santa Ana Heights, the City Manager believes staff should be directed to study the provision of City services to the area and also study the revenue and expenditure implications of such an annexation.
