HomeMy WebLinkAbout13 - Orange County Museum of Art Banners0 CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 13 January 13, 2004 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Gilbert Wong, Associate Engineer 949 - 644 -3311 gwong@city.newport-beach.ca.us SUBJECT: APPROVAL OF ORANGE COUNTY MUSEUM OF ART BANNERS — ENCROACHMENT PERMIT N2003 -0475 RECOMMENDATION: Conditionally approve the request of the Orange County Museum of Art for the installation of 99 banners, from January 16, 2004 to April 25, 2004, for the annual Art Banner Program. Installation shall be along Jamboree Road, MacArthur Boulevard, Westcliff Drive, San Joaquin Hills Road, and San Clemente Drive. DISCUSSION: The Orange County Museum of Art has requested that 99 private banners be installed from January 16, 2004, through April 25, 2004, mostly in the Fashion Island area for the Orange County Museum of Art. The banners will be mounted by Little Foot Construction, a contractor hired by the Museum at their expense on street light poles in the public right -of -way along Jamboree Road (35 banners), Westcliff Drive (9 banners), MacArthur Boulevard (34 banners), San Joaquin Hills Road (13 banners) and San Clemente Drive (8 banners). See attached Exhibit. The Banners are to advertise the "Picasso to Pollock" and "Cities of Promise" Exhibits that are being shown between January 16, 2004 and April 25, 2004, The Museum has designed a 2 -foot by 6 -foot banner mounted with only a top bracket as approved by the Public Works Department and Utilities Department. The event is not co- sponsored by the City of Newport Beach, is not free to the public, and does not exclude advertisement of the sponsor (Bank of America, Los Angeles Times & Automobile Club of Southern California) as required per City Council Policy L- 16. Council Policy L -16 prohibits the use of a commercial sponsor's name on the banner. However, the event will be community -wide, open to the public, and may SUBJECT: Approval of Orange County Art Museum Banners - Encroachment Permit Number N2003 -0475 January 13, 2004 Page 2 create additional revenue to the City through restaurants, businesses, and hotel reservations. is Should the City Council elect to approve the installation of 99 private banners in the Fashion Island area for approximately 3.5 months, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles. 2. The applicant must provide on -going maintenance of the banners and brackets. 3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a financial size category of "VIII" or higher. 5. Issuance of an Encroachment Permit by the Public Works Department (Encroachment Permit No N2003- 0475). 6. The banners shall conform to City Council Policy L -16 with the exception of the number of banners, advertisement of sponsor, open to the public free of charge, and co- sponsor by the City. 7. All banners and brackets shall be removed by the end of the approved time unless otherwise approved by the conditions stated in the Encroachment Permit. 8. All banners and brackets shall comply with the Encroachment Permit conditions. 9. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. 10. A minimum of two 5 -inch wide half - circle wind slits per banner are required to minimize the wind load. 11. The printed font of the sponsors, Bank of America, Los Angeles Times & Automobile Club of Southern California, shall be the same size or smaller than the "Orange' logo. Environmental Review: Staff determined that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the Guidelines. This exemption covers the 0 11 SUBJECT: Approval of Orange County Art Museum Banners - Encroachment Permit Number N2003 -0475 January 13, 2004 Page 3 minor alteration of existing public facilities with negligible or no expansion of the facilities in areas that are not environmentally sensitive. Funding Availability: The Orange County Art Museum will pay all costs associated with the installation and removal of the banners in addition to the $430.30 encroachment permit fee to cover permit processing and inspection costs incurred by the City.
