Before speaking, please state your name for the record. REQUEST FOR CONTINUANCES: CONSENT CALENDAR Notice to the Public All matter(s) listed under CONSENT CALENDAR (Item 1) is considered by the Commission to be routine and will all be enacted by one motion in the form listed below. The Planning Commission Members have received detailed staff reports on each of the items recommending an action. There will be no separate discussion of these items prior to the time the Commission votes on the motion unless members of the Commission, staff or the public request specific items to be discussed and/or removed from the Consent Calendar for separate action. Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern upon invitation by the Chairman, state their name and Consent Calendar Item number. ITEM NO. 1. SUBJECT: Minutes of the adjourned and regular meeting of December 4, 2003. ACTION: Approve as written and order filed. HEARING ITEMS: ITEM NO. 2. Fair Residence (PA2003 -226) 456 Mendoza Terrace SUBJECT Modification Permit No. 2003 -094 SUMMARY: Appeal of the Modifications Committee's approval of the following encroachments: 1) an exterior staircase and guardrails in the east side yard setback; 2) a second floor deck in the front yard setback adjacent to De Sola Terrace; 3) a replacement of an existing concrete block wall in the front setback on Mendoza Terrace; 4) a new concrete block retaining wall along the west side property line, portions of which will exceed the height limit; 5) and a new retaining wall and patio in the De Sola Terrace setback in conjunction with the remodel and addition to the existing single family residence. ACTION: Deny the appeal and uphold and affirm the decision of the Modifications Committee and approve Modification Permit No. 2003 -094. ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS TAPE RECORDED. SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. (Red light signifies when three minutes are up; yellow light signifies that the speaker has one minute left for summation.) ITEM NO. 3. Leo Gugasian (PA2003 -174) 1100 W. Coast Highway SUBJECT: Development Plan No. 2003 -002 & Use Permit No. 2003 -026 SUMMARY: Use Permit and Development Plan for the construction and operation of a • vehicle sales facility and the redevelopment of an existing commercial center. Two existing buildings totaling approximately 13,000 square feet will be demolished and replaced with an 11,300 square foot automobile sales building and a 6,500 square foot retail /office building. The project also includes a redesigned and combined parking lot. The application includes a parking modification to reduce the minimum number of parking spaces, an off -site parking agreement for a shared parking lot on two adjacent properties, and a request to exceed the base floor area ratio by approximately 6 %. ACTION: Staff recommends approval of the amended project subject to the findings and conditions in the attached draft resolution (Exhibit No. 3). (All Ayes) Item 2, regarding Fair residence, 456 Mendoza Terrace Modification Permit No. 2003 -226 (PA 2003 -201), the appeal of the decision of the Modifications Committee was approved and is subject to appeal or call up by the City Council. (6 Ayes, 1 No) Item 3, regarding Leo Gugasian Center, 900 -1040 West Coast Highway, Use Permit No. 2003 -026 and Development Plan No. 2003 -002 (PA2003 -174), was approved and is subject to appeal or call up by the City Council.
