SUBJECT: Appropriation of $73,944.77 from the Affordable Housing Trust Deposit to
Account #0510 -8080 and Account #7014- C2700706 to pay various legal
and consulting fees related to Bayview Landing Coastal Commission
Entitlement.
ISSUE:
Appropriate funds to pay consultant contracts in support of the Bayview Landing
Coastal Commission entitlement process.
RECOMMENDATION:
Approve a budget amendment appropriating $65,368.70 from the Affordable Housing
Trust Deposit to City Attorney's Professional Services account and $8,576.07 to the
Bayview Affordable Housing CIP account.
DISCUSSION:
Background:
On November 5, 2003 The Coastal Commission approved a revised development plan for
a 120 unit affordable senior housing project at the Lower Bayview site as well as a 10 acre
park on Upper Bayview. The site is southwest of the intersection of Jamboree Road and
Back Bay Drive. All 120 units will be affordable and will assist the City in meeting our
regional housing requirements. The plans for the project had been approved by the City
Council, Planning Commission, and Parks, Beaches and Recreation Commission.
This is in addition to the $200,000 previously transferred for services related to the City's
entitlement process. $50,000 was initially transferred to Account #7014- C2700706 to pay
for consultant services during the City's entitlement process and another $50,000 was
transferred to the same account for consultant services during the Coastal Commission

entitlement process. The additional $8,576.07 is a result of additional environmental
consultant services related to the wetlands issue. The previous $100,000 transfer to
Account #0510 -8080 was for legal services related to the Coastal Commission entitlement
process including the July 2003 hearing. The $65,368.70 is a result of the additional legal
services needed for the second Coastal Commission hearing in November 2003. The
total for all entitlement services comes to $273, 944.77, of which approximately $50,000
was for City entitlement and $224,000 was for Coastal entitlement.
Environmental Review:
Not subject to CEQA, as the activity is not a project, as defined in Section 15378(b)(4).
Public Notice:
None Required.
Fundinq Availability:
The Affordable Housing Mitigation Fund has an approximate balance of $2.5 million
dollars.
Alternatives:
The City Council may choose not to appropriate the funds for this project.
