Before speaking, please state your name for the record. REQUEST FOR CONTINUANCES: CONSENT CALENDAR Notice to the Public All matters) listed under CONSENT CALENDAR (Item 1 and 1B) is considered by the Commission to be routine and will all be enacted by one motion in the form listed below. The Planning Commission Members have received detailed staff reports on each of the items recommending an action. There will be no separate discussion of these items prior to the time the Commission votes on the motion unless members of the Commission, staff or the public request specific items to be discussed and /or removed from the 10 Consent Calendar for separate action. Members of the public who wish to discuss a Consent Calendar item should come forward to the lectem upon invitation by the Chairman, state their name and Consent Calendar Item number. ITEM NO. 1. SUBJECT: Minutes of the adjourned and regular meeting of February 5, 2004. ACTION: Approve as written and order filed. HEARING ITEMS: ITEM NO. 2. SUBJECT Ronald P. Tomsic Deck Extension (PA2003 -299) 448 Isabella Terrace SUMMARY: The expansion of an existing second -floor deck that will encroach into the required 15 -foot front yard setback at the view side of the property overlooking Rivera Terrace. The ground floor patio will also be expanded but will not exceed the Code Permitted 3 -feet in height. ACTION: Modify the decision of the Modifications Committee to approve Modification Permit No. 2003 -122 and approve the applicant's original request by adopting revised findings and conditions. ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS TAPE RECORDED, SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. ITEM NO. 3 SUBJECT: New Superior Group, LLC (PA2003 -122) 500 -540 Superior Avenue SUMMARY: Traffic Study pursuant to the Traffic Phasing Ordinance (TPO) for a possible increase in the amount of general office uses within the Newport Technology Center. ACTION: Approve Traffic Study No. 2003 -001 by adopting the draft resolution attached to the staff report. ITEM NO. 4 SUBJECT: TRP Development Services (PA2003 -252) 494/496 Old Newport Blvd. SUMMARY: Request for approval of a Use Permit and Traffic Study to allow the construction of new 12,000 square foot medical office building that exceeds the maximum permitted Floor Area Ratio and Building Bulk. The applicant also requests aproval of an off- street parking credit for proposed on- street parking spaces. ACTION: Approve Use Permit No. 2003 -043 & Traffic Study No. 2004 -001 limiting the building to 11,359 gross square feet by adopting the draft resolution attached to the staff report. ITEM NO. 5 SUBJECT: Local Coastal Program, Land Use Plan Update (PA2003 -093) SUMMARY: Comprehensive update of the Land Use Plan of the City of Newport Beach Local Coastal Program. ACTION: Conduct the public hearing; provide direction to staff on potential revisions to the Coastal Land Use Plan; continue hearing to March 18, 2004. Temple, Planning Director SUBJECT: Planning Commission Agenda —March 4, 2004 Report of the actions of the Planning Commission Meeting: Item 1, regarding minutes of February 5, 2004, was amended and approved. (All Ayes) Item 2, regarding 448 Isabella Terrace, Modification Permit No. 2003 -122 (PA2003 -299), the decision of the Modifications Committee was modified and approved. (6 Ayes, 1 Recused) Item 3, regarding 500 -540 Superior Avenue, Traffic Study No. 20003 -001 (PA2003- 122), was continued to April 8, 2004 at the request of staff to allow time for further review of additional information. (All Ayes) Item 4, regarding 494 -496 Old Newport Blvd., Use Permit No. 2003 -043 and Traffic Study No. 2004 -001 (PA2003 -252), was approved.
