SUBJECT: RELEASE OF SURETY FOR CONCRETE ALLEY EXTENSION
STRUCTURE ADJACENT TO 405 GOLDENROD AVENUE —
ENCROACHMENT PERMIT NO. N2001 -0110
DEVELOPER: ERIC WELTON, G/B VENTURE, LLC.
RECOMMENDATION:
1. Accept the concrete alley extension work in conjunction with Encroachment
Permit No. N2001 -0110.
2. Authorize the City Clerk to release the $8,000.00 refundable faithful performance
surety retained by the City as a guarantee for completing the remaining alley
extension work.
DISCUSSION:
On April 10, 2001, the City Council conditionally approved Encroachment Permit No.
N2001 -0110 (Permit) which included the construction of an alley extension structure to
provide access to garages that serve 405 and 405 % Goldenrod Avenue. Accordingly,
G/B Venture submitted a Faithful Performance Surety and a Labor and Materials
Surety, each in the amount of $29,000, to guarantee the completion of the required
work within the public right -of -way.
On September 25, 2001, the City Council directed the City Clerk to release the held
sureties contingent upon receipt from G/B Venture a reduced surety in the amount of
$8,000.00 as a guarantee to complete the remaining work. G/B Venture submitted the
$8,000.00 reduced surety (check no. 5030040353) to the City on September 26, 2001.
Said surety was deposited into Account No. 010 -2202 (see attached receipt).

The remaining work consisting of chain -link fencing and screen landscaping under and
around the alley extension structure has been completed in conformance with the plans
and specifications and within the 18 -month construction period stipulated by the Permit.
G/B Venture has requested in writing that the $8,000.00 surety retained by the City be
released (see attached letter). Staff has reviewed and concurs with said release
request.

Provisions of CEQA are not applicable.
