SUBJECT: MEASURE M ELIGIBILITY RE- QUALIFICATION FOR FY 2004 -05
RECOMMENDATIONS:
1. Adopt the Seven -Year Capital Improvement Program.
2. Direct staff to submit the adopted Capital Improvement Program and
Maintenance of Effort certification to the Orange County Transportation
Authority to satisfy the eligibility provisions for the Measure M and the
Congestion Management Programs.
3. Adopt Resolution No. 2004 - pertaining to the status of the City's
Circulation Element.
DISCUSSION:
On November 6, 1990, Orange County voters approved Measure M, the half -cent sales
tax provision for transportation improvement purposes. The Orange County
Transportation Authority (OCTA) is the transportation monitoring agency for the County.
Specific documentation must be submitted to OCTA each year to maintain funding
eligibility for the Measure M and Congestion Management Programs. In FY 2004 -05, the
City will receive approximately $1,165,000 in Turnback Funds.
In order to continue to receive funding, the City must satisfy the following requirements by
June 30, 2004:
1. Adopt a Seven -Year Capital Improvement Program (CIP) that includes all
projects with Measure M funding. This Program is a continuation of the CIP
adopted last year with other projects to reflect funding priority changes.
2. Certify the requirements of the Maintenance of Effort (MOE).

3. Adopt a resolution pertaining to the status of the City's Circulation Element
and affirming there has been no unilateral reduction in lanes on any Master
Plan of Arterial Highways during Fiscal Years 2003 and 2004.
The City has complied with the above criteria in all years since the inception of the
Measure M program in 1993. Since then, the City has received approximately $24
million in Measure M Local Turnback and Competitive funds.
An MOE requirement of $8,229,000 has been established, whereby the City must
expend at least this amount within the General Fund on street related activities each
fiscal year. The City's proposed funding of $9,713,526 for FY 2004 -05 satisfies this
requirement.
A confirming report regarding all the above items will be submitted to OCTA to ensure
continued eligibility under the various funding programs.
Environmental Review:
An environmental review is not required at this time; this action is administrative in
nature and environmental review will be performed for each capital project prior to its
implementation.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY NEWPORT BEACH CONCERNING THE
STATUS OF THE CIRCULATION ELEMENT
WHEREAS the City of Newport Beach desires to maintain and improve the
streets within its jurisdiction, including those arterials contained in the Master Plan of
Arterial Highways (MPAH), and
WHEREAS the City of Newport Beach has endorsed a definition of and a
process for, determining consistency of the City's Traffic Circulation Plan with the MPAH,
and
WHEREAS the City has adopted a General Plan Circulation Element which
does not preclude implementation of the MPAH within its jurisdiction, and
WHEREAS the City has adopted a resolution informing the Orange County
Transportation Authority (OCTA) that the City's Circulation Element is in conformance
with the Master Plan of Arterial Highways and whether any changes to any arterial
highways of said Circulation Element have been adopted by the City during Fiscal Years
2003 and 2004.
NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach,
does hereby inform the OCTA that:
a) The arterial highway portion of the City Circulation Element of the City is in
conformance with the OCTA Master Plan of Arterial Highways.
b) The City attests that no unilateral reduction in through lanes has been made on any
MPAH arterials during the Fiscal Years 2003 and 2004.
c) The City has adopted a uniform setback ordinance providing for the preservation of
rights -of -way consistent with the MPAH arterial highway classification.
d) The City has adopted provisions for the limitation of access to arterial highway in order
to protect the integrity of the system.
