SUBJECT: ORDINANCE AMENDING SECTION 12.32.020(B) OF THE NEWPORT
BEACH MUNICIPAL CODE
RECOMMENDATION:
Introduce Ordinance No. 2004 - amending Chapter 12.32 (Restricted Use of
Certain Streets), Section 12.32.020(B) (Commercial Vehicles Prohibited from Using
Certain Streets — Signposting) of the Newport Beach Municipal Code, prohibiting
commercial vehicles which exceed 6,000 pounds from using Ridge Park Road from
Newport Coast Drive to Vista Ridge Road.
DISCUSSION:
As part of the overall effort to improve the circulation, access, and safety to Newport
Coast Elementary School users, staff recommends prohibiting the use of Ridge Park
Road from Newport Coast Drive to Vista Ridge Road by commercial vehicles exceeding
6,000 pounds. Large trucks using this steep street impede traffic flow in the vicinity of
the school in the morning due to the extremely slow speeds they can achieve while
turning from Newport Coast Drive onto Ridge Park Road and as they proceed up the
steep hill towards their destination. At the time school lets out, large trucks are often
coming down this steep hill and would not be able to stop if a car or pedestrian were to
enter the street.
Currently, large commercial vehicles serving construction at the northerly end of Ridge
Park Road utilize the roadway, as it is the most direct route to Newport Coast Drive.
The proposed restriction would redirect large commercial vehicle traffic from the lower
section of Ridge Park Road to Vista Ridge Road. Vista Ridge Road is a collector
roadway, which can accommodate the additional traffic. Exhibit 1 shows the proposed
commercial vehicle route.
The Police Department, Public Works Department, and the City Manager's office have
worked very closely for several months with the Newport Mesa Unified School District
along with the Principal and concerned parents from Newport Coast Elementary School

to improve :safety in the vicinity of the School. A number of changes are proposed to be
implemented with the start of school next month. These changes include the use of the
new Loop Road, closure of the school driveway during pick -up and drop -off times, and
parking restrictions as well as the truck weight restriction. The Traffic Engineer is
authorized by the Municipal Code to implement all of these changes except for the truck
weight limit. The Traffic Engineer is further authorized by the Municipal Code to
institute temporary measures to improve safety while City Council action is pending and
this weight limit will be in place for the start of school unless directed otherwise.
Advance notification of the proposed truck restriction was made to numerous interested
parties including the managers for the Pelican Ridge Estates, Trovare, Altezza, Ocean
Heights, and Los Trancos associations. This announcement was in the form of an e-
mail from Assistant City Manager Kiff. This restriction was also on the agenda for the
Newport Coast Advisory Committee's August 2, 2004, meeting. At the NCAC meeting
some concern was expressed that shifting more truck traffic to Vista Ridge was
inappropriate since the residents had been living with truck traffic for many years.
Environmental Review:
Categorically Exempt under Chapter 3, Article 19, Section 15301, Class 1 (c) of the
Title 14 California Code of Regulations. Exemption for the operation of existing
facilities.

ORDINANCE NO. 2004 -
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING SECTION 12.32.020(b) OF
THE NEWPORT BEACH MUNICIPAL CODE TO PROHIBIT
COMMERCIAL VEHICLES EXCEEDING 6,000 POUNDS
FROM OPERATING ON CERTAIN STREETS WITHIN THE
CITY LIMITS.
The City Council of the City of Newport Beach does hereby ordain as follows:
Section 1: Section 12.32.020(b) of the Newport Beach Municipal Code is
amended to read:
12.32.020(b). The following streets are the streets designated by the City Council upon
which commercial vehicles exceeding 6,000 pounds gross weight may not be operated:
1. Acacia Avenue, from Coast Highway to Pacific Drive;
2. Alba Street;
3. Aliso Avenue;
4. Avocado Avenue, from Coast Highway to Waterfront Drive;
5. Back Bay Drive, from San Joaquin Hills Road to Eastbluff Drive;
6. Beacon Avenue;
7. Begonia Avenue, from Coast Highway to Pacific Drive;
8. Bison Avenue, between Jamboree Road and Alta Vista Drive;
9. Bixia Street;
10. Bolsa Avenue;
11. Cacao Street;
12. Carnation Avenue, from Coast Highway to Bayside Drive;
13, Catalina Avenue;
14, Clay Avenue;
15. Cliff Drive, from Dover Drive to Irvine Avenue;
16. Cliff Drive, westerly of Riverside Avenue;

Council of the City of Newport Beach held on the 27th day of July, 2004, and adopted
on the __ day of August, 2004, by the following vote, to wit:
