Rescind Resolution No. 2004 -97 endorsing the application for an Urban Streams Restoration Grant. 2. Adopt resolution No. 2005- endorsing the revised application for an Urban Streams Restoration Grant. DISCUSSION: This resolution supercedes a similar resolution approved by Council on December 11, 2004. Under this revised resolution, the construction of a detention facility in Buck Gully North of Coast Highway is added. The City is now applying for grant funding from the California Department of Water Resources Urban Streams Restoration Program (Proposition 40) to fund the design, permitting, and construction of a stabilization project near the mouth of Buck Gully as well as the construction of a detention facility in Buck Gully North of Coast Highway. The area near the mouth of Buck Gully has seen significant erosive scour and headcutting which will continue if no mitigation measures are taken. The detention facility is required in order to construct effective stabilizing structures downstream. The preliminary estimate of the funding request for all work has increased from $500,000 to $1,000,000. The grant application requires a resolution from the City stating the following: The City is sponsoring the project An explanation of how CEQA will be addressed The designated person (by title of position) from the agency to sign a grant contract The designated person (by title of position) who will act as Project Manager The Friends of Newport Coast will co- sponsor the project and have volunteered to assist in preparing the grant application. Badum blic Works Director RESOLUTION NO. 2004 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ENDORSING APPLICATION FOR AN URBAN STREAMS RESTORATION GRANT AND DETERMINING APPROPRIATE ENVIRONMENTAL IMPACT DOCUMENT, CONDITIONALLY ACCEPTING GRANT IF OFFERED, AND DESIGNATING PROJECT MANAGER AND FISCAL AGENT WHEREAS, the City of Newport Beach intends to design, permit, and construct the Buck Gully Stabilization Project; and WHEREAS, the California Department of Water Resources, Division of Planning and Local Assistance, Urban Streams Restoration Program has announced the availability of funds for grants; and WHEREAS, said grants are intended to help solve flooding and erosion problems in a way that provides environmental enhancement; and WHEREAS, the Friends of Newport Coast has proposed to cosponsor a grant application with the City of Newport Beach; and WHEREAS, the City Council has concluded the project proposed for funding with the grant funds would be environmentally beneficial and an Environmental Impact Report will be prepared in conformance with CEQA prior to the implementation of the project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach approves the joint application with the Friends of Newport Coast for an Urban Streams Restoration Program grant. BE IT FURTHER RESOLVED THAT, if offered such a grant, the City Council authorizes the Public Works Director to accept and sign any contract for administration of the grant funds, and the City's Principal Civil Engineer to act as Project Manager for the project. The City Council hereby delegates authority to the Project Manager to manage the Agreement, and to delegate authority to others to provide management and support services required for performance of the work and administration of the Agreement. The delegation of authority to submit invoices requires written consent by both grantees which will be provided to the Department of Water Resources. Adopted this 14'h day of December, 2004.
