TITLE: Resolution Endorsing the Application for an Urban Streams Restoration Program
Grant Application
ABSTRACT:
Staff recently submitted a grant application to the California Department of Water Resources (DWR) for
habitat restoration of a 1,000 foot reach of lower Big Canyon Creek just west of Jamboree Road. The grant
application requires City Council to adopt a resolution endorsing the grant proposal.
RECOMMENDATION:
Adopt Resolution No. 2015 -11, A Resolution of the City Council of the City of Newport Beach Endorsing
the Application for an Urban Streams Restoration Program Grant, and Determining Appropriate
Environmental Impact Document, Conditionally Accepting Grant if Offered, and Designating Project
Representative, Contract Manager, and Fiscal Agent.
FUNDING REQUIREMENTS:
The grant application to DWR requests funding of $997,500. While there is no match fund requirement for
this grant, the proposed Big Canyon treatment wetland is adjacent to this stream restoration area and will
be constructed during the same scheduling window as an integrated project. Therefore, to garner
additional grant application points, the City is showing funding for the treatment wetland as match funding
for this grant. Funding for the treatment wetland includes approximately $1.6 million from OCTA Measure
M and $600,000 from Irvine Company Settlement Funds. No portion of the proposed match is from the City
general funds.
DISCUSSION:
To end ongoing erosion and enhance natural processes that sustain complex riparian habitat conditions at
Big Canyon Creek, the design and implementation of a creek restoration project is proposed to restore
approximately 1,000 feet of Big Canyon Creek downstream of Jamboree Road. A boulder step -pool
structure will be constructed at the Jamboree Road culvert outfall to dissipate energy, stabilize the channel
invert and end localized bank erosion. Water in the step -pool structure will be pumped to the proposed

treatment wetland
The stream banks will be regraded and stabilized using biotechnical methods such as willow mattresses,
live willow pole plantings, as well as biodegradable wattles and fabrics to provide immediate structural
support to the banks while the re- vegetation program is being established. The left bank of the creek may
be modified to allow large storm flows to overflow the creek bank and flood over a larger area of the
canyon bottom to reduce downstream erosion in the creek and facilitate growth of native plants.
Restoration in the downstream portions will include select grading and floodplain lowering, extensive
native plantings, and the addition of large wood structures to encourage secondary channel formation,
floodplain inundation, and wetland expansion. The New Irvine Ranch Conservancy is teaming with the City
to assist with implementation of this proposed project.
Per the requirements of the grant application, the City Council must approve a resolution stating:
1. The City Council approves the joint application with the New Irvine Ranch Conservancy for an Urban
Streams Restoration Program grant.
2. If offered such a grant, the City Council authorizes the City Manager or his designee to accept and
sign any contract for administration of the grant funds, and the Public Works Director or his designee to act
as Project Manager for the project.
3. The City Council hereby delegates authority to the Public Works Director or his designee to manage
the Agreement including the submission of invoices, and to delegate authority to others to provide
management and support services required for performance of the work and administration of the
Agreement.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060
(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in
physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

RESOLUTION NO. 2015-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
ENDORSING THE APPLICATION FOR AN URBAN STREAMS RESTORATION
PROGRAM GRANT, AND DETERMINING APPROPRIATE ENVIRONMENTAL
IMPACT DOCUMENT, CONDITIONALLY ACCEPTING GRANT IF OFFERED, AND
DESIGNATING PROJECT REPRESENTATIVE, CONTRACT MANAGER, AND
FISCAL AGENT.
WHEREAS, the California Department of Water Resources, FloodSAFE
Environmental Stewardship and Statewide Resources Office, Urban Streams
Restoration Program has announced the availability of funds for grants; and
WHEREAS, said grants are intended to help solve flooding and erosion problems
in a way that provides environmental enhancement; and
WHEREAS, the City of Newport Beach has proposed to sponsor a grant
application with the Irvine Ranch Conservancy; and
WHEREAS, the City of Newport Beach has concluded the project proposed for
funding would be environmentally beneficial and the City of Newport Beach will comply
with all requirements of CEQA and other environmental permits prior to implementation
of the project; and
WHEREAS, the City of Newport Beach considers the prospects of receiving a
grant to be reasonably likely.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DOES RESOLVE AS FOLLOWS:
Section 1. The City Council approves the joint application with the Irvine Ranch
Conservancy for an Urban Streams Restoration Program grant.

Section 2. If offered such a grant, the City Council authorizes the City Manager
or his designee to accept and sign any contract for administration of the grant funds,
and the Public Works Director or his designee to act as Project Manager for the project.
Section 3. The City Council hereby delegates authority to the Public Works
Director or his designee to manage the Agreement including the submission of invoices,
and to delegate authority to others to provide management and support services

HEREBY CERTIFY that the foregoing resolution was duly and regularly
