Temple (949) 644 -3232 ptemple @city.newport- beach.ca.us SUBJECT: Planning Commission Agenda for March 3, 2005 Report of the actions of the Planning Commission Regular Meeting: Item 1: The minutes of February 17, 2005 were approved. (All Ayes) Item 2: Anthony's River Boat Restaurant (Use Permit 3684) 151 W. Coast Highway This was a review of a previously approved Use Permit for a restaurant operated in conjunction with the Newport Harbor Nautical Museum. The purpose of the review was to determine if the conditions of approval were effective to address noise related issues previously experienced from the establishment. The Planning Commission received testimony that few problems have occurred in the previous two years. Because of this, the Planning Commission eliminated the condition of approval which required the review. This item is subject to appeal by the City Council. (All Ayes) Item 3: City of Newport Beach (PA2004 -235) Housing Element These amendments to the Housing Element consist largely of revisions necessary to insure internal consistency and to make corrections to Code references. One of the amendments is necessary to allow the consideration of the housing in -lieu fee ordinance currently being drafted. The amendments were recommended for approval and is automatically forwarded to City Council. (All Ayes) Item 4: Rudy's Pub and Grill Amendment (PA2004 -273) 3110 Newport Boulevard This Use Permit will provide for a substantial renovation and a small addition to the existing restaurant and bar. Discussion of the Planning Planning Commission Agenda March 8, 2005 Page 2 Commission focused on hours of operation, noise control and the ability of the facility to provide live entertainment. These concerns were highlighted because part of the proposal is to install a retractable roof which will allow the bulk of the seating area to be open to the sky during some hours of operation. The Planning Commission approved the project, allowing the roof to be open only until 10:00 PM, live entertainment within the building until 10:00 PM, and use of the outdoor patio until 1:00 AM. This item is subject to appeal by the City Council. (All Ayes) Item 5. Chris Brigandi (PA2004 -273) 500 315{ Street This Use Permit is to allow the construction of a mixed -use, commercial and residential project in the Cannery Village area. Discussion of the Planning Commission focused on the increased setbacks from Villa way, 31St Street and alley, all of which were found to provide a design of high quality which met the required finding for approval. The Planning Commission Members have received detailed staff reports on each of the items recommending an action. There will be no separate discussion of these items prior to the time the Commission votes on the motion unless members of the Commission, staff or the public request specific items to be discussed and /or removed from the Consent Calendar for separate action. Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern upon invitation by the Chairman, state their name and Consent Calendar Item number. ITEM NO. 1. SUBJECT: Minutes of the regular meeting of February 17, 2004. ACTION: Approve as written and order filed. HEARING ITEMS: ITEM NO. 2. SUBJECT Anthony's River Boat Restaurant 151 W. Coast Highway SUMMARY: On June 7, 2001, Anthony's Riverboat Restaurant received approval of Use Permit No. 3684 that authorized the use of third level of the Pride of Newport for banquet events. This approval is subject to specific limitations of regarding activities and hours of operation on the exterior decks. The Planning Commission also required that the operation be reviewed for the effectiveness of and compliance with conditions of approval. ACTION: Receive public testimony and take appropriate action. ALL TESTIMONY GIVEN BEFORE THE PLANNING COMMISSION IS TAPE RECORDED. SPEAKERS MUST LIMIT REMARKS TO THREE MINUTES ON ALL ITEMS. (Red light signifies when three minutes are up; yellow light signifies that the speaker has one minute left for summation.) ITEM NO. 3. SUBJECT: City of Newport Beach SUMMARY: Amendments to the Housing Element of the Newport Beach General Plan to eliminate discrepancies and insure consistency within the text, clarify existing policies and affordability standards, and include additional provisions to promote the achievement of the City's housing goals. These amendments include: 1) Amend Housing Program 1.2.1 to provide consistent dates for the annual reporting of the Housing Element and General Plan. 2) Amend Housing Program 2.1.1 to correct an erroneous reference to the Municipal Code. 3) Expand Housing Program 2.2.1 to include provisions for the production of housing affordable to moderate - income households. 4) Provide consistency within the Housing Element when defining affordable income categories, and amend the affordability standards to be consistent with the standards used by the State Department of Housing and Community Development and Office of the Attorney General. ACTION: Adopt resolution recommending approval of General Plan Amendment No. 2004 -010 to the City Council. ITEM NO. 4. SUBJECT: Rudy's Pub and Grill (PA2004 -273) 3110 Newport Boulevard SUMMARY: Request to permit additions and alterations to an existing eating and drinking establishment. The applicant proposes to add a retractable roof over a portion of the building, an exterior patio adjacent to Newport Boulevard and second floor office space. The Modification Permit request is to permit alterations of portions of the first floor and the new second floor office space that encroach 4 feet into the required 10 -foot alley setback. ACTION: Approve Use Permit No. 2004 -049 and Modification Permit No. 2004 -089, subject to the findings and conditions of approval. ITEM NO. S. SUBJECT: Chris Brigandi 500 31 st Street SUMMARY: The applicant requests the establishment of a height limit in excess of the 26- foot base limit pursuant to Section 20.65.055 of the Municipal Code. The applicant proposes to construct a mixed use building with an average roof height of 30 feet and 9 inches and a peak height of 32 feet approximately. ACTION: Approve Use Permit No. 2005 -001 subject to the findings and conditions of approval included within the attached resolution.
