SUBJECT: CONTINUE PUBLIC HEARING FOR PROPOSED UNDERGROUND
UTILITIES DISTRICT NO. 19 SANTA ANA HEIGHTS — MESA DRIVE,
CYPRESS STREET AND A PORTION OF ORCHARD DRIVE

Continue Public Hearing for the proposed Underground Assessment District No. 19,
Santa Ana Heights, until April 26, 2005 when legal issues and use of RDA funds should
be resolved between the County of Orange and City of Newport Beach.
DISCUSSION:
A Public Hearing was originally scheduled for January 11, 2005 to decide whether to form
an Underground Utilities District (UUD). The Hearing was continued until March 22, 2005
because of a disagreement between our Special Counsel's opinion about the use of
redevelopment funds for private property utility hook -ups and the opinion of the County of
Orange's Special Counsel. Currently, both counsels, the City Manager's office, Council
Member Daigle, and Supervisor Silva are attempting to resolve this issue prior to holding
the Public Hearing and forming the UUD.
Staff recommends continuing the Public Hearing until April 26, 2005 when these issues
should be resolved.
Environmental Review:
A Notice of Exemption was completed October 22, 2004, and filed with the County
Recorder on October 29, 2004. A Certificate of Environmental Proceedings was
completed on November 9, 2004.
